    Amends the Children's Product Safety Act. Prohibits a person from selling, offering to sell, leasing, or offering to lease a crib bumper pad in the State. Imposes a civil penalty of not less than $100 and not more than $500 for each violation.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Children's Product Safety Act is amended by
5adding Section 16 and changing Section 25 as follows:
 
6    (430 ILCS 125/16 new)
7    Sec. 16. Crib bumper pads.
8    (a) For purposes of this Section:
9        (1) "Crib" means any bed with barred or latticed sides
10    designed for an infant or toddler.
11        (2) "Crib bumper pad" means any padding material,
12    including, but not limited to, a roll of stuffed fabric,
13    that is designed for placement within a crib to cushion one
14    or more of the crib's inner sides adjacent to the crib
15    mattress.
16    (b) No person shall sell, lease, offer for sale, or offer
17for lease any crib bumper pad as a separate item or as an
18accessory to a crib in the State.
19    (c) Any person who violates this Section is subject to a
20civil penalty of not less than $100 nor more than $500 for each
21offense.

1    Sec. 25. Penalty. Except as provided in Sections 16 and
2Section 20, a commercial dealer, importer, distributor,
3wholesaler, or retailer who violates this Act by failing to
4exercise reasonable care is subject to a civil penalty in an
5amount not to exceed $500 for each day that the violation
6continues.
