SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/1-218.3 new
625 ILCS 5/11-1101  from Ch. 95 1/2, par. 11-1101

    Amends the Illinois Vehicle Code. Defines "vehicle used for public transportation purposes" as a vehicle owned and operated by an interstate transportation authority, municipality, or other public or private entity to provide local transportation service within an interstate transportation district, municipality, or county, and includes busses, trains, and any other means of conveyance by any type of power, operated for public use in the conveyance of persons. Provides that a Section concerning passing a street car on the left also concerns passing other vehicles used for public transportation purposes. Provides that bicycles are subject to the Section concerning passing a street car or other vehicle used for transportation purposes on the left. Effective immediately.

1    AN ACT concerning vehicles.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-1101 and by adding Section 1-218.3 as follows:
 
6    (625 ILCS 5/1-218.3 new)
7    Sec. 1-218.3. Vehicle used for public transportation
8purposes. A vehicle owned and operated by an interstate
9transportation authority, municipality, or other public or
10private entity to provide local transportation service within
11an interstate transportation district, municipality, or
12county, and includes busses, trains, and any other means of
13conveyance by any type of power, operated for public use in the
14conveyance of persons.

16    Sec. 11-1101. Passing street car or other vehicle used for
17public transportation purposes on left.
18    (a) The driver of a vehicle or bicycle shall not overtake
19and pass upon the left nor drive upon the left side of any
20street car or other vehicle used for public transportation
21purposes proceeding in the same direction, whether such street
22car or other vehicle used for public transportation purposes is

1actually in motion or temporarily at rest, except:
2    1. When so directed by a police officer;
3    2. When upon a one-way street; or
4    3. When upon a street where the tracks are so located as to
5prevent compliance with the section.
6    (b) The driver of any vehicle or bicycle when permitted to
7overtake and pass upon the left of a street car or other
8vehicle used for public transportation purposes which has
9stopped for the purpose of receiving or discharging any
10passenger shall reduce speed and may proceed only upon
11exercising due caution for pedestrians and shall accord
12pedestrians the right-of-way when required by other Sections of
13this Chapter.

15    Section 99. Effective date. This Act takes effect upon
