SYNOPSIS AS INTRODUCED:
 
820 ILCS 310/20.5 new

    Amends the Workers' Compensation Act. Provides that an employee shall reimburse the employer for the actual costs incurred by the employer for an independent medical examination if the employee has notice of the examination appointment, does not attend the examination, and does not cancel the examination appointment in a timely manner.

1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Workers' Occupational Diseases Act is
5amended by adding Section 20.5 as follows:
 
6    (820 ILCS 310/20.5 new)
7    Sec. 20.5. Payment of costs incurred in connection with
8independent medical examination.
9    (a) An employee shall reimburse the employer for the actual
10costs incurred by the employer for an independent medical
11examination if the employee:
12        (1) has notice of the appointment for the independent
13    medical examination;
14        (2) does not attend the appointment for the independent
15    medical examination; and
16        (3) does not cancel the appointment for the independent
17    medical examination in a timely manner.
18    (b) An employer seeking reimbursement under this Section
19shall petition the Commission for an order establishing the
20amount due under this Section. The order shall provide for the
21manner and time of payment of the amount ordered to be
22reimbursed.
