AMENDMENT TO HOUSE BILL 4191

2    AMENDMENT NO. ______. Amend House Bill 4191 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Officials and Employees Ethics Act is
5amended by changing Section 20-52 as follows:
 
6    (5 ILCS 430/20-52)
7    Sec. 20-52. Release of summary reports.
8    (a) Within 60 days after receipt of a summary report and
9response from the ultimate jurisdictional authority or agency
10head, if the conduct at issue in the report that resulted in a
11suspension of at least 3 days or termination of employment, or
12if an Executive Inspector General determines, and the
13Commission agrees, that the conduct at issue in the report
14resulted in the loss of public funds in an amount of $5,000 or
15greater, the Executive Ethics Commission shall make available
16to the public the report and response or a redacted version of

1the report and response. The Executive Ethics Commission may
2make available to the public any other summary report and
3response of the ultimate jurisdictional authority or agency
4head or a redacted version of the report and response.
5    (b) The Commission shall redact information in the summary
6report that may reveal the identity of witnesses, complainants,
7or informants or if the Commission determines that the identity
8of any person named in the report is unnecessary, or that it is
9appropriate to protect the identity of a person before the
10report is made public. The Commission may also redact any
11information it believes should not be made public. Prior to
12publication, the Commission shall permit the respondents, the
13Executive Inspector General, and Attorney General to review
14documents to be made public and offer suggestions for redaction
15or provide a response that shall be made public with the
16summary report.
17    (c) The Commission may withhold publication of the report
18or response if the Executive Inspector General or Attorney
19General certifies that releasing the report to the public will
20interfere with an ongoing investigation.
