SYNOPSIS AS INTRODUCED:
 
See Index

    Creates the Department of Education Act and amends the Civil Administrative Code of Illinois, the School Code, the Board of Higher Education Act, and the Public Community College Act. Creates the Department of Education, with a Secretary of Education as its head. Provides that, in order to create continuity between all levels of education, the Department shall oversee the State Board of Education, the Board of Higher Education, and the Illinois Community College Board and coordinate and streamline the functions of these boards until January 1, 2014. Provides that all of the rights, powers, duties, and functions vested by law in the State Board of Education (except the State Board of Education's duty under the Illinois Constitution to appoint a chief State educational officer), the State Superintendent of Education, the Board of Higher Education, and the Illinois Community College Board are transferred to the Department of Education on January 1, 2014; abolishes the Board of Higher Education and the Illinois Community College Board on that date. Provides for the transfer of personnel and property. Makes other changes.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Department of Education Act.
 
6    Section 5. Department defined. In this Act, "Department"
7means the Department of Education.
 
8    Section 10. General powers and duties.
9    (a) The Department shall begin operation on July 1, 2013.
10The Department shall exercise the rights, powers, duties, and
11functions provided by law, including without limitation the
12rights, powers, duties, and functions transferred to the
13Department under Section 15 of this Act.
14    (b) The Department may employee persons, provide
15facilities, contract for goods and services, and adopt rules as
16necessary to carry out its functions and purposes, all in
17accordance with applicable law.
18    (c) In order to create continuity between all levels of
19education, the Department shall oversee the State Board of
20Education, the Board of Higher Education, and the Illinois
21Community College Board and coordinate and streamline the
22functions of these boards until January 1, 2014.

1    (d) The Department shall create an Elementary and Secondary
2Education Division and a Vocational Education Division within
3the Department.
 
4    Section 15. Transfer of powers. Except as otherwise
5provided in subsection (b) of Section 2 of Article X of the
6Constitution of the State of Illinois and subsection B of
7Section 1A-4 of the School Code, all of the rights, powers,
8duties, and functions vested by law in the State Board of
9Education, the State Superintendent of Education, the Board of
10Higher Education, or the Illinois Community College Board or in
11any office, council, committee, division, or bureau of the
12State Board of Education, the State Superintendent of
13Education, the Board of Higher Education, or the Illinois
14Community College Board are transferred to the Department on
15January 1, 2014.
 
16    Section 20. Transfer of personnel.
17    (a) Personnel employed by the State Board of Education, the
18State Superintendent of Education, the Board of Higher
19Education, or the Illinois Community College Board on December
2031, 2013 are transferred to the Department on January 1, 2014.
21    (b) The Department shall continue in effect all collective
22bargaining agreements in existence on December 31, 2013 between
23the State Board of Education, the Board of Higher Education, or
24the Illinois Community College Board and labor organizations

1representing personnel of the State Board of Education, the
2Board of Higher Education, or the Illinois Community College
3Board, respectively, and the Department shall continue to
4recognize these labor organizations as the exclusive
5bargaining representatives for the personnel, pursuant to the
6Illinois Educational Labor Relations Act.
7    (c) The rights of State employees, the State, and its
8agencies under the Personnel Code and applicable collective
9bargaining agreements and retirement plans are not affected by
10this Act.
 
11    Section 25. Transfer of property. All books, records,
12documents, property (real and personal), unexpended
13appropriations, including both obligated and unobligated
14appropriations, and pending business pertaining to the rights,
15powers, duties, and functions transferred to the Department
16under this Act shall be transferred and delivered to the
17Department on January 1, 2014, unless otherwise directed by the
18Governor. The Department is the successor agency of the State
19Board of Education, the State Superintendent of Education, the
20Board of Higher Education, and the Illinois Community College
21Board for purposes of Section 9b of the State Finance Act and
22the Successor Agency Act.
 
23    Section 30. Rules, standards, and procedures.
24    (a) The rules, standards, and procedures of the State Board

1of Education, the State Superintendent of Education, the Board
2of Higher Education, or the Illinois Community College Board
3that are in effect on December 31, 2013 and pertain to the
4rights, powers, duties, and functions transferred to the
5Department under this Act shall become the rules, standards,
6and procedures of the Department on January 1, 2014 and shall
7continue in effect until amended or repealed by the Department.
8    (b) Any rules pertaining to the rights, powers, duties, and
9functions transferred to the Department under this Act that
10have been proposed by the State Board of Education, the State
11Superintendent of Education, the Board of Higher Education, or
12the Illinois Community College Board but have not taken effect
13or been finally adopted or on before December 31, 2013 shall
14become proposed rules of the Department on January 1, 2014, and
15any rulemaking procedures that have already been completed by
16the State Board of Education, the State Superintendent of
17Education, the Board of Higher Education, or the Illinois
18Community College Board for those proposed rules need not be
19repeated.
 
20    Section 35. Savings provisions.
21    (a) The rights, powers, duties, and functions transferred
22to the Department by this Act shall be vested in and exercised
23by the Department subject to the provisions of this Act. An act
24done by the Department or an officer, employee, or agent of the
25Department in the exercise of the transferred rights, powers,

1duties, or functions shall have the same legal effect as if
2done by the State Board of Education, the Board of Higher
3Education, or the Illinois Community College Board or an
4officer, employee, or agent of the State Board of Education,
5the Board of Higher Education, or the Illinois Community
6College Board.
7    (b) The transfer of rights, powers, duties, and functions
8to the Department under this Act does not invalidate any
9previous actions taken by or in respect to the State Board of
10Education, the Board of Higher Education, or the Illinois
11Community College Board or its officers, employees, or agents.
12On January 1, 2014, references to the State Board of Education,
13the Board of Higher Education, or the Illinois Community
14College Board or its officers, employees, or agents in any
15document, contract, agreement, or law (other than this Act,
16Sections 1A-0.01, 1A-1, 1A-2, 1A-2.1, 1A-3.5, and 1A-4 of the
17School Code, Section 2 of the Board of Higher Education Act,
18and Section 2-1 of the Public Community College Act) shall, in
19appropriate contexts, be deemed to refer to the Department or
20its officers, employees, or agents.
21    (c) The transfer of rights, powers, duties, and functions
22to the Department under this Act does not affect any person's
23rights, obligations, or duties, including any civil or criminal
24penalties applicable thereto, arising out of those transferred
25rights, powers, duties, and functions.

2amended by changing Sections 5-15 and 5-20 and by adding
3Section 5-338 as follows:

1    Sec. 1A-3.5. Report to Department of Education. The State
2Board of Education shall report directly to the Department of
3Education, shall comply with all requests from the Department
4of Education, and shall exercise those powers and perform those
5duties assigned to the State Board of Education by the
6Department of Education, with the Elementary and Secondary
7Education Division of the Department of Education being the
8appropriate authority with respect to matters regarding
9elementary and secondary education and the Vocational
10Education Division of the Department of Education being the
11appropriate authority with respect to matters regarding
12vocational education.

14    Sec. 1A-4. Powers and duties of the Board and Department.
15    A. (Blank).
16    B. The State Board of Education Board shall determine the
17qualifications of and appoint a chief education officer, to be
18known as the State Superintendent of Education, who may be
19proposed by the Governor and who shall serve at the pleasure of
20the Board and pursuant to a performance-based contract linked
21to statewide student performance and academic improvement
22within Illinois schools. Upon expiration or buyout of the
23contract of the State Superintendent of Education in office on
24the effective date of this amendatory Act of the 93rd General
25Assembly, a State Superintendent of Education shall be

1appointed by a State Board of Education that includes the 7 new
2Board members who were appointed to fill seats of members whose
3terms were terminated on the effective date of this amendatory
4Act of the 93rd General Assembly. Thereafter, a State
5Superintendent of Education must, at a minimum, be appointed at
6the beginning of each term of a Governor after that Governor
7has made appointments to the Board. A performance-based
8contract issued for the employment of a State Superintendent of
9Education entered into on or after the effective date of this
10amendatory Act of the 93rd General Assembly must expire no
11later than February 1, 2007, and subsequent contracts must
12expire no later than February 1 each 4 years thereafter. No
13contract shall be extended or renewed beyond February 1, 2007
14and February 1 each 4 years thereafter, but a State
15Superintendent of Education shall serve until his or her
16successor is appointed. Each contract entered into on or before
17January 8, 2007 with a State Superintendent of Education must
18provide that the State Board of Education may terminate the
19contract for cause, and the State Board of Education shall not
20thereafter be liable for further payments under the contract.
21With regard to this amendatory Act of the 93rd General
22Assembly, it is the intent of the General Assembly that,
23beginning with the Governor who takes office on the second
24Monday of January, 2007, a State Superintendent of Education be
25appointed at the beginning of each term of a Governor after
26that Governor has made appointments to the Board. The State

1Superintendent of Education shall not serve as a member of the
2State Board of Education, but . The Board shall set the
3compensation of the State Superintendent of Education who shall
4serve as the Board's chief executive officer. The State
5Superintendent of Education shall receive an annual salary as
6set by the Governor. The Board shall also establish the duties,
7powers and responsibilities of the State Superintendent, which
8shall be included in the State Superintendent's
9performance-based contract along with the goals and indicators
10of student performance and academic improvement used to measure
11the performance and effectiveness of the State Superintendent.
12The State Board of Education may delegate to the State
13Superintendent of Education the authority to act on the Board's
14behalf, provided such delegation is made pursuant to adopted
15board policy or the powers delegated are ministerial in nature.
16The State Board may not delegate authority under this Section
17to the State Superintendent to (1) nonrecognize school
18districts, (2) withhold State payments as a penalty, or (3)
19make final decisions under the contested case provisions of the
20Illinois Administrative Procedure Act unless otherwise
21provided by law.
22    The State Board of Education's powers and duties are
23limited by law, as provided in Section 2 of Article X of the
24Illinois Constitution, to those powers and duties specified
25under Section 1A-3.5 of this Code.
26    C. The powers and duties of the Department State Board of

1Education shall encompass all duties delegated to the Office of
2Superintendent of Public Instruction on January 12, 1975,
3except as the law providing for such powers and duties is
4thereafter amended, and such other powers and duties as the
5General Assembly shall designate. The Department Board shall be
6responsible for the educational policies and guidelines for
7public schools, pre-school through grade 12 and Vocational
8Education in the State of Illinois. The Department Board shall
9analyze the present and future aims, needs, and requirements of
10education in the State of Illinois and recommend to the General
11Assembly the powers which should be exercised by the Department
12Board. The Department Board shall recommend the passage and the
13legislation necessary to determine the appropriate
14relationship between the Department Board and local boards of
15education and the various State agencies and shall recommend
16desirable modifications in the laws which affect schools.
17    D. (Blank). Two members of the Board shall be appointed by
18the chairperson to serve on a standing joint Education
19Committee, 2 others shall be appointed from the Board of Higher
20Education, 2 others shall be appointed by the chairperson of
21the Illinois Community College Board, and 2 others shall be
22appointed by the chairperson of the Human Resource Investment
23Council. The Committee shall be responsible for making
24recommendations concerning the submission of any workforce
25development plan or workforce training program required by
26federal law or under any block grant authority. The Committee

1will be responsible for developing policy on matters of mutual
2concern to elementary, secondary and higher education such as
3Occupational and Career Education, Teacher Preparation and
4Certification, Educational Finance, Articulation between
5Elementary, Secondary and Higher Education and Research and
6Planning. The joint Education Committee shall meet at least
7quarterly and submit an annual report of its findings,
8conclusions, and recommendations to the State Board of
9Education, the Board of Higher Education, the Illinois
10Community College Board, the Human Resource Investment
11Council, the Governor, and the General Assembly. All meetings
12of this Committee shall be official meetings for reimbursement
13under this Act. On the effective date of this amendatory Act of
14the 95th General Assembly, the Joint Education Committee is
15abolished.
16    E. Five members of the State Board of Education Board shall
17constitute a quorum. A majority vote of the members appointed,
18confirmed and serving on the Board is required to approve any
19action, except that the 7 new Board members who were appointed
20to fill seats of members whose terms were terminated on the
21effective date of this amendatory act of the 93rd General
22Assembly may vote to approve actions when appointed and
23serving.
24    Using the most recently available data, the Department of
25Education Board shall prepare and submit to the General
26Assembly and the Governor on or before January 14, 2014 1976

1and annually thereafter a report or reports of its findings and
2recommendations. Such annual report shall contain a separate
3section which provides a critique and analysis of the status of
4education in Illinois and which identifies its specific
5problems and recommends express solutions therefor. Such
6annual report also shall contain the following information for
7the preceding year ending on June 30: each act or omission of a
8school district of which the Department State Board of
9Education has knowledge as a consequence of scheduled, approved
10visits and which constituted a failure by the district to
11comply with applicable State or federal laws or regulations
12relating to public education, the name of such district, the
13date or dates on which the Department State Board of Education
14notified the school district of such act or omission, and what
15action, if any, the school district took with respect thereto
16after being notified thereof by the Department State Board of
17Education. The report shall also include the statewide high
18school dropout rate by grade level, sex and race and the annual
19student dropout rate of and the number of students who graduate
20from, transfer from or otherwise leave bilingual programs. The
21Auditor General shall annually perform a compliance audit of
22the Department State Board of Education's performance of the
23reporting duty imposed by this amendatory Act of 1986. A
24regular system of communication with other directly related
25State agencies shall be implemented.
26    The requirement for reporting to the General Assembly shall

1be satisfied by filing copies of the report with the Speaker,
2the Minority Leader and the Clerk of the House of
3Representatives and the President, the Minority Leader and the
4Secretary of the Senate and the Legislative Council, as
5required by Section 3.1 of the General Assembly Organization
6Act, and filing such additional copies with the State
7Government Report Distribution Center for the General Assembly
8as is required under paragraph (t) of Section 7 of the State
9Library Act.
10    F. Upon appointment of the 7 new Board members who were
11appointed to fill seats of members whose terms were terminated
12on the effective date of this amendatory Act of the 93rd
13General Assembly, the Board shall review all of its current
14rules in an effort to streamline procedures, improve
15efficiency, and eliminate unnecessary forms and paperwork.

17    Section 100. The Board of Higher Education Act is amended
18by changing Section 2 and by adding Section 5.5 as follows:

20    Sec. 2. Board of Higher Education; abolishment.
21    (a) There is created a Board of Higher Education to consist
22of 16 members as follows: 10 members appointed by the Governor,
23by and with the advice and consent of the Senate; one member of
24a public university governing board, appointed by the Governor

1without the advice and consent of the Senate; one member of a
2private college or university board of trustees, appointed by
3the Governor without the advice and consent of the Senate; the
4chairman of the Illinois Community College Board; the chairman
5of the Illinois Student Assistance Commission; and 2 student
6members selected by the recognized advisory committee of
7students of the Board of Higher Education, one of whom must be
8a non-traditional undergraduate student who is at least 24
9years old and represents the views of non-traditional students,
10such as a person who is employed or is a parent. Beginning on
11July 1, 2005, one of the 10 members appointed by the Governor,
12by and with the advice and consent of the Senate, must be a
13faculty member at an Illinois public university. The Governor
14shall designate the Chairman of the Board to serve until a
15successor is designated. The chairmen of the Board of Trustees
16of the University of Illinois, the Board of Trustees of
17Southern Illinois University, the Board of Governors of State
18Colleges and Universities, and the Board of Regents of Regency
19Universities shall cease to be members of the Board of Higher
20Education on the effective date of this amendatory Act of 1995.
21No more than 7 of the members appointed by the Governor,
22excluding the Chairman, shall be affiliated with the same
23political party. The 10 members appointed by the Governor with
24the advice and consent of the Senate shall be citizens of the
25State and shall be selected, as far as may be practicable, on
26the basis of their knowledge of, or interest or experience in,

1problems of higher education. If the Senate is not in session
2or is in recess, when appointments subject to its confirmation
3are made, the Governor shall make temporary appointments which
4shall be subject to subsequent Senate approval.
5    (b) On January 1, 2014, the Board is abolished and the
6terms of all members end. Except for references in this
7Section, beginning on January 1, 2014, references in this Act
8to the Board of Higher Education shall, in appropriate
9contexts, be deemed to refer to the Department of Education.

13    Sec. 5.5. Report to Department of Education. The Board
14shall report directly to the Department of Education, shall
15comply with all requests from the Department of Education, and
16shall exercise those powers and perform those duties assigned
17to the Board by the Department of Education. This Section is
18repealed on January 1, 2014.
 
19    Section 105. The Public Community College Act is amended by
20changing Section 2-1 and by adding Section 2-9.5 as follows:
 
21    (110 ILCS 805/2-1)  (from Ch. 122, par. 102-1)
22    Sec. 2-1. Illinois Community College Board; abolishment.
23    (a) There is created the Illinois Community College Board

1hereinafter referred to as the "State Board". The State Board
2shall consist of 12 members as follows: a nonvoting student
3member selected by the recognized advisory committee of
4students of the Illinois Community College Board, this student
5to serve for a term of one year beginning on July 1 of each
6year, except that the student member initially selected shall
7serve a term beginning on the date of such selection and
8expiring on the next succeeding June 30, and except that any
9student member or former student member may be selected by the
10recognized advisory committee of students of the State Board to
11serve a second term as the nonvoting student member of the
12State Board; and 11 members, one of whom shall be a senior
13citizen age 60 or over, to be appointed by the Governor by and
14with the advice and consent of the Senate. Beginning on July 1,
152005, one of the 11 members appointed by the Governor, by and
16with the advice and consent of the Senate, must be a faculty
17member at an Illinois public community college. Also beginning
18on July 1, 2005, one of the 11 members appointed by the
19Governor, by and with the advice and consent of the Senate,
20must be a member of the board of trustees of a public community
21college district. The membership requirements set forth in this
22Section apply only to the State Board and shall have no effect
23on the membership of the board of trustees of a community
24college district. The members first appointed under this
25amendatory Act of 1984 shall serve for a term of 6 years. After
26the expiration of the terms of the office of the members first

1appointed to the State Board, their respective successors shall
2hold office for a term of 6 years and until their successors
3are qualified and seated. In the event of vacancies on the
4State Board in offices appointed by the Governor occurring
5during a recess of the Senate, the Governor shall have the
6power to make temporary appointments until the next meeting of
7the Senate, when the vacancy shall be filled by nomination to
8be confirmed by the Senate.
9    (b) On January 1, 2014, the State Board is abolished and
10the terms of all members end. Except for references in this
11Section, beginning on January 1, 2014, references in this Act
12to the Illinois Community College Board shall, in appropriate

17    Sec. 2-9.5. Report to Department of Education. The State
18Board shall report directly to the Department of Education,
19shall comply with all requests from the Department of
20Education, and shall exercise those powers and perform those
21duties assigned to the State Board by the Department of
22Education, with the Vocational Education Division of the
23Department of Education being the appropriate authority with
24respect to matters regarding vocational education. This
25Section is repealed on January 1, 2014.
