AMENDMENT TO HOUSE BILL 2362

2    AMENDMENT NO. ______. Amend House Bill 2362 on page 4, by
3replacing lines 19 through 26 with the following:
4    "(6) Records and communications may be disclosed to a
5court-appointed therapist, psychologist, or psychiatrist for
6use in determining a person's fitness to stand trial if the
7records were made within the 180-day period immediately
8preceding the date of the therapist's, psychologist's or
9psychiatrist's court appointment. These records and
10communications shall be admissible only as to the issue of the
11person's fitness to stand trial. Records and communications may
12be disclosed when such are made during treatment which the
13recipient is ordered to undergo to render him fit to stand
14trial on a criminal charge, provided that the disclosure is
15made only with respect to the issue of fitness to stand
16trial."; and
 
17on page 5, by deleting lines 1 thorough 7.
