    Amends the Illinois Public Aid Code. Makes a technical change in a Section regarding the treatment of trusts as they affect eligibility for medical assistance.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-2.1a as follows:
 
6    (305 ILCS 5/5-2.1a)
7    Sec. 5-2.1a. Treatment of trust amounts. To the the extent
8required by federal law, the Illinois Department shall provide
9by rule for the consideration of trusts and similar legal
10instruments or devices established by a person in the Illinois
11Department's determination of the person's eligibility for and
12the amount of assistance provided under this Article. This
13Section shall be enforced by the Department of Human Services,
14acting as successor to the Department of Public Aid under the
15Department of Human Services Act.
