SYNOPSIS AS INTRODUCED:
 
705 ILCS 405/5-760 new

    Amends the Juvenile Court Act of 1987. Provides that if a minor is found to be a delinquent minor by reason of the commission of a gang-related offense, and the court finds that the minor is a first-time offender and orders that a parent, guardian, or legal custodian retain custody of that minor, the court may order the parent, guardian, or legal custodian to attend antigang violence parenting classes. Provides that the Department of Children and Family Services shall establish the curriculum for the antigang violence parenting classes. Provides that the father, mother, spouse, or other person liable for the support of the minor, the estate of that person, and the estate of the minor shall be liable for the cost of classes, unless the court finds that the person or estate does not have the financial ability to pay.

1    AN ACT concerning violence prevention.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Juvenile Court Act of 1987 is amended by
5adding Section 5-760 as follows:
 
6    (705 ILCS 405/5-760 new)
7    Sec. 5-760. Antigang violence parenting classes.
8    (a) If a minor is found to be a delinquent minor by reason
9of the commission of a gang-related offense, and the court
10finds that the minor is a first-time offender and orders that a
11parent, guardian, or legal custodian retain custody of that
12minor, the court may order the parent, guardian, or legal
13custodian to attend antigang violence parenting classes.
14    (b) The Department of Children and Family Services shall
15establish the curriculum for the antigang violence parenting
16classes required under this Section, including, but not limited
17to, all of the following criteria:
18        (1) A meeting in which the families of innocent victims
19    of gang violence share their experience.
20        (2) A meeting in which the surviving parents of a
21    deceased gang member share their experience.
22        (3) How to identify gang and drug activity in children.
23        (4) How to communicate effectively with adolescents.

1        (5) An overview of pertinent support agencies and
2    organizations for intervention, education, job training,
3    and positive recreational activities, including telephone
4    numbers, locations, and contact names of those agencies and
5    organizations.
6        (6) The potential fines and periods of incarceration
7    for the commission of additional gang-related offenses.
8        (7) The potential penalties that may be imposed upon
9    parents for aiding and abetting crimes committed by their
10    children.
11    (c) The father, mother, spouse, or other person liable for
12the support of the minor, the estate of that person, and the
13estate of the minor shall be liable for the cost of classes
14ordered under this Section, unless the court finds that the
15person or estate does not have the financial ability to pay. In
16evaluating financial ability to pay, the court shall take into
17consideration the combined household income, the necessary
18obligations of the household, the number of persons dependent
19upon this income, and whether reduced monthly payments would
20obviate the need to waive liability for the full costs.
21    (d) For purposes of this Section, "gang-related" has the
22meaning ascribed to it in Section 10 of the Illinois Streetgang
23Terrorism Omnibus Prevention Act.
