AMENDMENT TO HOUSE BILL 1887

2    AMENDMENT NO. ______. Amend House Bill 1887 as follows:
 
3on page 1, line 6, by replacing "13" with "26"; and
 
4on page 2, immediately below line 23, by inserting the
5following:
6    ""Responsible managing employee" means an individual who
7has met the qualifications set forth under Section 20 of this
8Act for designated certified persons except for subsection (a)
9of Section 20 of this Act and who obtained his or her license
10prior to January 1, 2011 under Section 120 of this Act."; and
 
11by deleting line 3 on page 3 through line 1 on page 5; and
 
12on page 9, line 24, after "insurance" by inserting ";
13renewals"; and

1on page 10, by replacing lines 3 through 18 with the following:
2    "(b) Each license must be renewed every 2 years. Each
3designated certified person or responsible managing employee
4must complete 16 hours of continuing education in the 2-year
5period following his or her renewal or initial licensure after
6the effective date of this amendatory Act of the 97th General
7Assembly. Current licensure as a professional engineer or proof
8of current NICET certification in Level III or IV shall satisfy
9this requirement for designated certified persons. Continuing
10education offered through nationally recognized building and
11fire code organizations and their affiliates; nationally
12recognized fire sprinkler organizations and their affiliates;
13institutions of higher education; educational bodies
14specializing in automatic fire suppression system technology;
15as well as other entities approved by the State Fire Marshal
16shall be also acceptable. All continuing education entities
17seeking to be approved providers of continuing education shall
18make application to the State Fire Marshal and offer programs
19that:
20        (1) contribute to the advancement, extension, or
21    enhancement of the professional skills or technical
22    knowledge of the licensee in the practice of fire sprinkler
23    contracting; and
24        (2) are developed and presented by persons with
25    education or experience in the subject manner of the
26    program."; and

1on page 11, immediately below line 13, by inserting the
2following:
 
3    (225 ILCS 317/26 new)
4    Sec. 26. Change of a responsible managing employee. When a
5licensee is without a responsible managing employee, the
6licensee shall notify the State Fire Marshal in writing within
730 days and the licensee shall employ a designated certified
8person no later than 180 days after the time the position of
9responsible managing employee becomes vacant. The State Fire
10Marshal may, after review of qualifications, accept a
11substitute responsible managing employee for the remainder of
12the current license period. Upon application for renewal a
13designated certified person will be required. Failing to fill
14the vacant position shall cause the license of the person or of
15the business organization to expire without further operation
16of law.".
