1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Metropolitan Water Reclamation District Act
5is amended by changing Sections 4.22, 4.23, and 4.25 as
6follows:
 
7    (70 ILCS 2605/4.22)  (from Ch. 42, par. 323.22)
8    Sec. 4.22. Solicitation of political contributions by a
9commissioner or an employee.
10    (a) During a commissioner's or an employee's compensated
11time, other than vacation, personal, holiday, or compensatory
12time off, the commissioner No officer or employee shall not
13solicit, orally or by letter, or give or receive, or be in any
14manner concerned in soliciting, or giving, or receiving any
15assessment, subscription, or contribution from any
16commissioner or employee member of the classified civil service
17for any party or political purpose whatever.
18    (b) For the purposes of this Section, "compensated time"
19means any time worked by or credited to an employee that counts
20toward any minimum work time requirement imposed as a condition
21of employment with the sanitary district, but does not include
22any designated holidays or any period when the employee is on a
23leave of absence. With respect to commissioners, "compensated

1time" means any period of time when the commissioner is on the
2premises under the control of the sanitary district and any
3other time when the commissioner is executing his or her
4official duties, regardless of location.
5    For the purposes of this Section, "compensatory time off"
6means authorized time off earned by or awarded to an employee
7to compensate in whole or in part for time worked in excess of
8the minimum work time required of that employee as a condition
9of employment with the sanitary district.

14    (a) No person shall solicit, orally or by letter, or be in
15any manner concerned in soliciting any assessment,
16contribution, or payment for any party or any political purpose
17whatever from any commissioner officer or employee during the
18commissioner's or employee's compensated time other than
19vacation, personal, holiday, or compensatory time off in the
20classified civil service.
21    (b) For the purposes of this Section, "compensated time"
22means any time worked by or credited to an employee that counts
23toward any minimum work time requirement imposed as a condition
24of employment with the sanitary district, but does not include

13    Sec. 4.25. Political contributions and campaigns.
14    (a) During a commissioner's or an employee's compensated
15time, other than vacation, personal, holiday, or compensatory
16time off, a commissioner or an No officer or employee in the
17service of the sanitary district shall not, directly or
18indirectly, give or hand over to any commissioner officer or
19employee in said classified civil service, or to any senator,
20or representative, or alderman, councilman, or trustee, any
21money or other valuable thing on account of or to be applied to
22the promotion of any party or political object whatever.
23    (b) During an employee's compensated time, other than
24vacation, personal, holiday, or compensatory time off, an No
25employee in the classified service shall not take any part in

1the management or affairs of any political party or in any
2political campaign, except to exercise his or her right as a
3citizen privately to express his or her opinion, and to cast
4his or her vote, provided, however, that an employee shall have
5the right to hold any public office, either by appointment or
6election, that is not incompatible with his or her duties as an
7employee of the District, and provided further that the such
8employee does not campaign or otherwise engage in political
9activity during his or her compensated time other than
10vacation, personal, holiday, or compensatory time off working
11hours.
12    (c) This Section shall not be deemed to authorize conduct
13prohibited by the Federal Hatch Act by employees subject to
14that said Act.
15    (d) For the purposes of this Section, "compensated time"
16means any time worked by or credited to an employee that counts
17toward any minimum work time requirement imposed as a condition
18of employment with the sanitary district, but does not include
19any designated holidays or any period when the employee is on a
20leave of absence. With respect to commissioners, "compensated
