1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by changing
5Section 13-101 as follows:
 
6    (220 ILCS 5/13-101)  (from Ch. 111 2/3, par. 13-101)
7    (Section scheduled to be repealed on July 1, 2013)
8    Sec. 13-101. Application of Act to telecommunications
9rates and and services. Except to the extent modified or
10supplemented by the specific provisions of this Article, the
11Sections of this Act pertaining to public utilities, public
12utility rates and services, and the regulation thereof, are
13fully and equally applicable to noncompetitive
14telecommunications rates and services, and the regulation
15thereof, except where the context clearly renders such
16provisions inapplicable. Except to the extent modified or
17supplemented by the specific provisions of this Article,
18Articles I through V, Sections 8-301, 8-305, 8-502, 8-503,
198-505, 8-509, 8-509.5, 8-510, 9-221, 9-222, 9-222.1, 9-222.2,
209-250, and 9-252.1, and Article X of this Act are fully and
21equally applicable to competitive telecommunications rates and
22services, and the regulation thereof except that Section 9-250
23shall not apply to competitive retail telecommunications

1services; in addition, as to competitive telecommunications
2rates and services, and the regulation thereof, and with the
3exception of competitive retail telecommunications service
4rates and services, all rules and regulations made by a
5telecommunications carrier affecting or pertaining to its
6charges or service shall be just and reasonable. As of the
7effective date of this amendatory Act of the 92nd General
8Assembly, Sections 4-202, 4-203, and 5-202 of this Act shall
9cease to apply to telecommunications rates and services.
