SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.786 new
625 ILCS 5/3-696 new

    Amends the Illinois Vehicle Code and State Finance Act. Provides for the issuance of Sons of the American Legion special license plates. Provides that an applicant shall be charged an additional fee of $15 at original issuance and an additional $10 upon renewal. Provides that $5 of the original issuance fee and renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that $10 of the original issuance fee and $5 of the renewal fee shall be deposited into the Sons of American Legion Scholarship Fund. Creates the Sons of American Legion Scholarship Fund as a special fund in the State treasury. Provides that all moneys in the Sons of the American Legion Scholarship Fund shall, subject to appropriation, be used for grants for scholarships for Illinois residents who are children of members of the Sons of the American Legion and who meet the academic, financial, and other requirements established by the Sons of the American Legion. Provides that all grants must be used at a college or university in Illinois.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.786 as follows:
 
6    (30 ILCS 105/5.786 new)
7    Sec. 5.786. The Sons of the American Legion Scholarship
8Fund.
 
9    Section 10. The Illinois Vehicle Code is amended by adding
10Section 3-696 as follows:
 
11    (625 ILCS 5/3-696 new)
12    Sec. 3-696. Sons of the American Legion license plates.
13    (a) The Secretary, upon receipt of an application made in
14the form prescribed by the Secretary, may issue special
15registration plates designated as Sons of the American Legion
16license plates. The special plates issued under this Section
17shall be fixed only to passenger vehicles of the first
18division, motor vehicles of the second division weighing not
19more man 8,000 pounds, and recreational vehicles as defined in
20Section 1-169 of this Code. Plates issued under this Section
21shall expire according to the multi-year procedure established

1by Section 3-414.1 of this Code.
2    (b) The design and color of the plate is wholly within the
3discretion of me Secretary, except that the phrase "Sons of the
4American Legion", and the official Emblem of the Sons of the
5American Legion shall be on the plates. The Secretary may allow
6the plates to be issued as vanity plates or personalized plates
7under Section 3-405.1 of the Code.
8    A series of letters and numbers shall be reserved for
9special plates issued pursuant to this Section to past
10detachment commanders of the Sons of the American Legion. The
11series of letters and numbers reserved under this Section shall
12have the prefix of "PDC" and be followed by 2 numerals ranging
13from 00-99 that designate the year that the past detachment
14commander last served. For example, "PDC 08" would identify the
15past detachment commander that last served during the year
162008. Certification by the detachment adjutant will be required
17in the form of a letter verifying service dates of the past
18detachment commander for issuance of the special plate.
19    (c) An applicant for the special plate shall be charged a
20$15 fee for original issuance in addition to the appropriate
21registration fee. Of this additional fee, $10 shall be
22deposited into the Sons of the American Legion Scholarship Fund
23and $5 shall be deposited into the Secretary of State Special
24License Plate Fund, to be used by the Secretary to help defray
25the administrative processing costs.
26    For each registration renewal period, a $10 fee, in

1addition to the appropriate registration fee, shall be charged.
2Of this additional fee, $5 shall be deposited into the Sons of
3the American Legion Scholarship Fund and $5 shall be deposited
4into the Secretary of State Special License Plate Fund.
5    (d) The Sons of the American Legion Scholarship Fund is
6created as a special fund in the State treasury. All moneys in
7the Sons of the American Legion Scholarship Fund shall be paid,
8subject to appropriation by the General Assembly and approval
9by the Secretary, as grants for scholarships for higher
10education. The scholarship recipients must be the children of
11current or former members of the Sons of the American Legion
12who meet the academic, financial, and other requirements
13established by the Sons of the American Legion. In addition,
14the recipients must be Illinois residents and must attend a
15college or university located within the State of Illinois.
