| 2 | | AMENDMENT NO. ______. Amend House Bill 1091 as follows:

| 3 | | on page 5, line 8 by replacing "Department," with "Department |
| 4 | | or"; and
|
| 5 | | on page 5, by replacing lines 9 through 11 with "Authority."; |
| 6 | | and
|
| 7 | | on page 5, line 12 by deleting "(i)"; and
|
| 8 | | on page 5, by replacing lines 16 through 19 with "under the |
| 9 | | jurisdiction of the Department or the Authority. The term |
| 10 | | "transportation facility" may refer"; and
|
| 11 | | on page 7, line 25, by inserting after the period the |
| 12 | | following: |
| 13 | | "The Authority may operate or provide operational services |
|

| 1 | | such as toll collection on highways which are developed or |
| 2 | | financed, or both, through a public-private agreement entered |
| 3 | | into by another public entity."; and

| 4 | | on page 46, line 16, by inserting after the period the |
| 5 | | following: |
| 6 | | "To implement the powers conferred by this Act, the |
| 7 | | transportation agency may establish rules and procedures for |
| 8 | | the procurement of a public-private agreement under this Act. |
| 9 | | Nothing contained in this Act is intended to supersede |
| 10 | | applicable federal law or to foreclose the use or potential use |
| 11 | | of federal funds. In the event any provision of this Act is |
| 12 | | inconsistent with applicable federal law or would have the |
| 13 | | effect of foreclosing the use or potential use of federal |
| 14 | | funds, the applicable federal law or funding condition shall |
| 15 | | prevail, but only to the extent of such inconsistency."; and
|
| 16 | | on page 53, line 18 by deleting "and by adding Section 15-195"; |
| 17 | | and
|
| 18 | | on page 60, by removing lines 1 through 11.
