AMENDMENT TO HOUSE BILL 172

2    AMENDMENT NO. ______. Amend House Bill 172 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short Title. This amendatory Act may be known
5as the Emergency Seniors and Youth Budget Relief Act of 2011.
 
6    Section 5. The Illinois Aeronautics Act is amended by
7adding Section 34c as follows:
 
8    (620 ILCS 5/34c new)
9    Sec. 34c. Baggage Fee Sharing Program.
10    (a) In all air navigation facilities located in this State
11that are not owned or controlled by the federal government, the
12Department shall collect a fee from any person operating
13aircraft for hire or reward in this State who charges and
14collects a fee in this State, from any person, for that
15traveling person to simultaneously transport tangible personal

1property on any civil aircraft operating in the State's
2airways, subject to the following conditions:
3        (1) The shared fee to be collected by the Department
4    pursuant to this Section shall be equal to the rate of
5    12.5% of all fees charged and collected in this State.
6        (2) All shared fees collected by the Department
7    pursuant to this Section shall be disbursed within 60 days
8    after receipt as follows: 2% to the county that the shared
9    fee was collected for deposit into the General Corporate
10    Fund; 2% to the Department of Transportation of this State
11    for administrative expenses related to the implementation
12    of this Section; 96% to the General Revenue Fund.
13        (3) The shared fee to be collected by the Department
14    pursuant to this Section is limited to those fees actually
15    collected in air navigation facilities in this State by
16    operators of aircraft for hire or reward from any person
17    physically present in this State.
18    (b) Fees charged and collected in this State by air
19schools, flying clubs, and sport parachutists are exempt from
20the provisions of this Section.
21    (c) The Department may promulgate rules that it finds
22appropriate to implement the Baggage Fee Sharing Program
23created by this Section.
24    (d) This Section is repealed on January 1, 2015.
 
25    Section 10. The Illinois Vehicle Code is amended by

1changing Section 13C-50 as follows:
 
2    (625 ILCS 5/13C-50)
3    Sec. 13C-50. Costs.
4    (a) Except as otherwise provided in paragraph (a)(5) or
5(b)(7) of Section 13C-15 or in subsection (c) of this Section,
6no fee shall be charged to motor vehicle owners for obtaining
7inspections required under this Chapter. The Vehicle
8Inspection Fund, which is a fund created in the State treasury
9for the purpose of receiving moneys from the Motor Fuel Tax
10Fund and other sources, shall be used, subject to
11appropriation, for the payment of the costs of the program,
12including reimbursement of those agencies of the State that
13incur expenses in the administration or enforcement of the
14program. The Vehicle Inspection Fund shall continue in
15existence notwithstanding the repeal of Chapter 13B. Any money
16in the Vehicle Inspection Fund on February 1, 2007, shall be
17used for the purposes set forth in this Chapter.
18    (b) The Agency may acquire, own, maintain, operate, sell,
19lease and otherwise transfer real and personal property and
20interests in real and personal property for the purpose of
21creating or operating inspection stations and for any other
22purpose relating to the administration of this Chapter, and may
23use money from the Vehicle Inspection Fund for these purposes.
24    (c) Beginning on the effective date of this amendatory Act
25of the 97th General Assembly and through December 31, 2014, a

1$10 fee shall be charged to motor vehicle owners for obtaining
2inspections required under this Chapter and shall be deposited
3into the General Revenue Fund.

5    Section 97. Severability. The provisions of this Act are
6severable under Section 1.31 of the Statute on Statutes".
