SYNOPSIS AS INTRODUCED:
 
430 ILCS 65/13.1  from Ch. 38, par. 83-13.1

    Amends the Firearm Owners Identification Card Act. Strikes a clause preventing provisions of ordinances from being invalid when they impose greater restrictions or limitations on the acquisition, possession and transfer of firearms than are imposed by this Act. Provides that regulation of the ownership and possession of firearms and related items are the exclusive powers of the State. Provides that any existing or future local ordinances or resolutions imposing any restrictions or limitations on the ownership or possession of firearms and related items are invalid or void. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Firearm Owners Identification Card Act is
5amended by changing Section 13.1 as follows:
 
6    (430 ILCS 65/13.1)  (from Ch. 38, par. 83-13.1)
7    Sec. 13.1. (a) The regulation of the ownership and
8possession of firearms and ammunition, components,
9accessories, or accoutrements for firearms are exclusive
10powers and functions of the State. A unit of local government,
11including a home rule unit, may not require the registration of
12the person or firearm or ammunition as a condition of ownership
13or possession.
14    (b) The provisions of any ordinance or resolution after the
15effective date of this amendatory Act of the 97th General
16Assembly by any unit of local government that imposes
17restrictions or limitations on the ownership or possession of
18firearms and ammunition, components, accessories, and
19accoutrements of firearms in a manner other than the
20requirements that are imposed by this Act or Article 24 of the
21Criminal Code of 1961 are invalid and all those existing
22ordinances and resolutions are void.
23    (c) This Section is a limitation of home rule powers under

1subsection (h) of Section 6 of Article VII of the Illinois
2Constitution.
3    The provisions of any ordinance enacted by any municipality
4which requires registration or imposes greater restrictions or
5limitations on the acquisition, possession and transfer of
6firearms than are imposed by this Act, are not invalidated or
7affected by this Act.
