1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Children and Family Services Act is amended
5by changing Section 4a as follows:
 
6    (20 ILCS 505/4a)  (from Ch. 23, par. 5004a)
7    Sec. 4a. (a) To administer child abuse prevention shelters
8and service programs for abused and neglected children, or
9provide for their administration by not-for-profit
10corporations, community-based organizations or units of local
11government.
12    The Department is hereby designated the single State agency
13for planning and coordination of child abuse and neglect
14prevention programs and services. On or before the first Friday
15in October April of each year, the Department shall submit to
16the Governor and the General Assembly a State comprehensive
17child abuse and neglect prevention plan. The plan shall:
18identify priorities, goals and objectives; identify the
19resources necessary to implement the plan, including estimates
20of resources needed to investigate or otherwise process reports
21of suspected child abuse or neglect and to provide necessary
22follow-up services for child protection, family preservation
23and family reunification in "indicated" cases as determined

1under the Abused and Neglected Child Reporting Act; make
2proposals for the most effective use of existing resources to
3implement the plan, including recommendations for the optimum
4use of private, local public, State and federal resources; and
5propose strategies for the development of additional resources
6to meet the goal of reducing the incidence of child abuse and
7neglect and reducing the number of reports of suspected child
8abuse and neglect made to the Department.
9    (b) The administration of child abuse prevention, shelters
10and service programs under subsection (a) shall be funded in
11part by appropriations made from the Child Abuse Prevention
12Fund, which is hereby created in the State Treasury, and in
13part by appropriations from the General Revenue Fund. All
14interest earned on monies in the Child Abuse Prevention Fund
15shall remain in such fund. The Department and the State
16Treasurer may accept funds as provided by Sections 507 and 508
17of the Illinois Income Tax Act and unsolicited private
18donations for deposit into the Child Abuse Prevention Fund.
19Annual requests for appropriations for the purpose of providing
20child abuse and neglect prevention programs and services under
21this Section shall be made in separate and distinct line-items.
22In setting priorities for the direction and scope of such
23programs, the Director shall be advised by the State-wide
24Citizen's Committee on Child Abuse and Neglect.
25    (c) Where the Department contracts with outside agencies to
26operate the shelters or programs, such outside agencies may

1receive funding from the Department, except that the shelters
2must certify a 20% financial match for operating expenses of
3their programs. In selecting the outside agencies to administer
4child shelters and service programs, and in allocating funds
5for such agencies, the Department shall give priority to new
6and existing shelters or programs offering the broadest range
7of services to the community served.
8    (d) The Department shall have the power to make grants of
9monies to fund comprehensive community-based services to
10reduce the incidence of family dysfunction typified by child
11abuse and neglect; to diminish those factors found to increase
12family dysfunction; and to measure the effectiveness and costs
13of such services.
14    (e) For implementing such intergovernmental cooperation
15and involvement, units of local government and public and
16private agencies may apply for and receive federal or State
17funds from the Department under this Act or seek and receive
18gifts from local philanthropic or other private local sources
19in order to augment any State funds appropriated for the
20purposes of this Act.
21    (f) For the purposes of this Section:
22    (1) The terms "abused child" and "neglected child" have
23meanings ascribed to them in Section 3 of the Abused and
24Neglected Child Reporting Act.
25    (2) "Shelter" has the meaning ascribed to it in Section 1-3
26of the Juvenile Court Act of 1987.
