SYNOPSIS AS INTRODUCED:
 
225 ILCS 735/9a  from Ch. 111, par. 709a

    Amends the Timber Buyers Licensing Act. On or after the effective date of the amendatory Act, provides that a timber buyer who purchases timber in the State shall no longer be required to deduct from the payment to the timber grower a percentage of the purchase price and forward such amount to the Department of Natural Resources. Provides that upon the effective date of the amendatory Act, a timber buyer is no longer required to pay to the Department, when the periodic report is submitted, a percentage amount equal to the gross value of the timber utilized during the period. Effective immediately.

1    AN ACT concerning professional regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Timber Buyers Licensing Act is amended by
5changing Section 9a as follows:
 
6    (225 ILCS 735/9a)  (from Ch. 111, par. 709a)
7    Sec. 9a. Until the effective date of this amendatory Act of
8the 97th General Assembly, when When a timber buyer purchases
9timber in this State, the buyer shall determine the amount to
10be paid for such timber, or the value of items to be bartered
11for such timber, and shall deduct from the payment to the
12timber grower an amount which equals 4% of the purchase price
13and shall forward such amount to the Department of Natural
14Resources, along with a report of the purchase on forms
15provided by the Department. On or after the effective date of
16this amendatory Act of the 97th General Assembly, this
17deduction shall no longer be required.
18    Every timber grower who utilizes timber produced on land he
19owns or operates for sawing into lumber, for processing, or for
20resale, except a person who occasionally uses his own timber
21for sawing or processing for his own use and not for resale,
22shall report periodically, as required by regulation of the
23Department, the quantity of timber produced and utilized by the

1owner or operator during the reporting period. Until the
2effective date of this amendatory Act of the 97th General
3Assembly, such Such timber grower shall pay to the Department,
4when the periodic report is submitted, an amount equal to 4% of
5the gross value of the timber utilized during the period. On or
6after the effective date of this amendatory Act of the 97th
7General Assembly, these payments shall no longer be required.
8The value of such timber shall be determined pursuant to rule
9of the Department. Such rules shall include a voluntary
10arbitration program for use in situations in which a dispute
11arises as to the gross value of the timber.
12    The fees required by this Section shall be deposited in the
13Illinois Forestry Development Fund, a special fund in the State
14Treasury, for the purposes of the "Illinois Forestry
15Development Act".

17    Section 99. Effective date. This Act takes effect upon
18becoming law.
