430 ILCS 65/13.1  from Ch. 38, par. 83-13.1

    Amends the Firearm Owners Identification Card Act. Denies home rule powers to require firearm training and instruction or to otherwise regulate the ownership or possession of firearms. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Firearm Owners Identification Card Act is
5amended by changing Section 13.1 as follows:
 
6    (430 ILCS 65/13.1)  (from Ch. 38, par. 83-13.1)
7    Sec. 13.1. It shall be unlawful for any unit of local
8government, including a home rule unit of government, to
9require any person to obtain training or instruction in order
10to own or posses a firearm for his or her personal use. It is
11declared to be the policy of this State that the regulation of
12the right to own or posses a firearm is an exclusive power and
13function of the State. A home rule unit may not regulate the
14ownership or possession of firearms. This Section is a denial
15and limitation of home rule powers and functions under
16subsection (h) of Section 6 of Article VII of the Illinois
17Constitution. The provisions of any ordinance enacted by any
18municipality which requires registration or imposes greater
19restrictions or limitations on the acquisition, possession and
20transfer of firearms than are imposed by this Act, are not
21invalidated or affected by this Act.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
