SYNOPSIS AS INTRODUCED:

    Amends the State Finance Act, State Property Control Act, Illinois Vehicle Code, Snowmobile Registration and Safety Act, and Boat Registration and Safety Act. Creates the Conservation Police Vehicle Fund as a special fund in the State treasury and provides that all moneys in the fund shall be used, subject to appropriation, by the Department of Natural Resources for the acquisition of new or replacement vehicles, watercraft, and snowmobiles for the Conservation Police. Provides for surcharges on violations issued by the Conservation Police ($20 for each violation), snowmobile registration ($2 per registration), and watercraft registration (ranging from $1 to $5 per registration) to be deposited into the Conservation Police Vehicle Fund.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by adding
5 Section Section 5.755 as follows:
 
6     (30 ILCS 105/5.755 new)
7     Sec. 5.755. The Conservation Police Vehicle Fund.
 
8     Section 10. The State Property Control Act is amended by
9 adding Section 7d as follows:
 
10     (30 ILCS 605/7d new)
11     Sec. 7d. Acquisition of Conservation Police vehicles. The
12 Conservation Police Vehicle Fund is created as a special fund
13 in the State treasury. All moneys in the Conservation Police
14 Vehicle Fund, subject to appropriation, shall be used by the
15 Department of Natural Resources for the acquisition of new or
16 replacement vehicles, watercraft, and snowmobiles for the
17 Conservation Police.
 
18     Section 15. The Illinois Vehicle Code is amended by
19 changing Section 16-104c as follows:

1     (625 ILCS 5/16-104c)
2     Sec. 16-104c. Court supervision fees.
3     (a) Any person who receives a disposition of court
4 supervision for a violation of any provision of this Code or a
5 similar provision of a local ordinance shall pay an additional
6 fee of $29, which shall be disbursed as follows:
7         (1) if an officer of the Department of State Police
8     arrested the person for the violation, $20 of the $29 fee
9     shall be deposited into the State Police Vehicle Fund in
10     the State treasury; or
11         (1.5) if an officer of the Department of Natural
12     Resources arrested the person for the violation, $20 of the
13     $30 fee shall be deposited into the Conservation Police
14     Vehicle Fund in the State treasury; or
15         (2) if an officer of any law enforcement agency in the
16     State other than the Department of State Police or the
17     Department of Natural Resources arrested the person for the
18     violation, $20 of the $29 fee shall be paid to the law
19     enforcement agency that employed the arresting officer and
20     shall be used for the acquisition or maintenance of police
21     vehicles; and
22         (3) $9 of the $29 fee shall be deposited into the
23     Drivers Education Fund.
24     (b) In addition to the fee provided for in subsection (a),
25 a person who receives a disposition of court supervision for
26 any violation of this Code or a similar provision of a local

1 ordinance shall also pay an additional fee of $6, if not waived
2 by the court. Of this $6 fee, $5.50 shall be deposited into the
3 Circuit Court Clerk Operation and Administrative Fund created
4 by the Clerk of the Circuit Court and 50 cents shall be
5 deposited into the Prisoner Review Board Vehicle and Equipment
6 Fund in the State treasury.
7     (c) The Prisoner Review Board Vehicle and Equipment Fund is
8 created as a special fund in the State treasury. The Prisoner
9 Review Board shall, subject to appropriation by the General
10 Assembly and approval by the Secretary, use all moneys in the
11 Prisoner Review Board Vehicle and Equipment Fund for the
12 purchase and operation of vehicles and equipment.

14     Section 20. The Snowmobile Registration and Safety Act is
15 amended by changing Sections 3-2 and 3-5 as follows:

17     Sec. 3-2. Identification Number Application.
18     (a) The owner of each snowmobile requiring numbering by
19 this State shall file an application for number with the
20 Department on forms approved by it. Effective with the 2010
21 registration year, the The application shall be signed by the
22 owner of the snowmobile and shall be accompanied by a fee of
23 $18 plus a registration surcharge of $2. The registration
24 surcharge shall be deposited into the Conservation Police

1 Vehicle Fund.
2     (b) When a snowmobile dealer sells a snowmobile the dealer
3 shall, at the time of sale, require the buyer to complete an
4 application for the registration certificate, collect the
5 required fee and mail the application and fee to the Department
6 no later than 14 days after the date of sale. Combination
7 application-receipt forms shall be provided by the Department
8 and the dealer shall furnish the buyer with the completed
9 receipt showing that application for registration has been
10 made.
11     (c) The This completed receipt in subsection (b) of this
12 Section shall be in the possession of the user of the
13 snowmobile until the registration certificate is received.
14     (d) No snowmobile dealer may charge an additional fee to
15 the buyer for performing this service required under this
16 subsection. However, no purchaser exempted under Section 3-11
17 of this Act shall be charged any fee or be subject to the other
18 requirements of this Section.
19     (e) The application form shall so state in clear language
20 the requirements of this Section and the penalty for violation
21 near the place on the application form provided for indicating
22 the intention to register in another jurisdiction.
23     (f) Each dealer shall maintain, for one year, a record in a
24 form prescribed by the Department for each snowmobile sold.
25 These records shall be open to inspection by the Department.
26     (g) Upon receipt of the application in approved form the

1 Department shall enter the same upon the records of its office
2 and issue to the applicant a certificate of number stating the
3 number awarded to the snowmobile and the name and address of
4 the owner.

7     Sec. 3-5. Transfer of Identification Number. The purchaser
8 of a snowmobile shall, within 15 days after acquiring same,
9 make application to the Department for the transfer to him of
10 the certificate of number issued to the snowmobile, giving his
11 name, his address and the number of the snowmobile. The
12 purchaser shall apply for a transfer-renewal as provided in
13 Section 3-2 of this Act for a fee of $18 for approximately 3
14 years. All transfers will bear September 30 expiration dates in
15 the calendar year of expiration. Upon receipt of the
16 application and fee, the Department shall transfer the
17 certificate of number issued to the snowmobile to the new
18 owner. Unless the application is made and fee paid within 30
19 days, the snowmobile shall be deemed to be without certificate
20 of number and it shall be unlawful for any person to operate
21 the snowmobile until the certificate is issued.

23     Section 25. The Boat Registration and Safety Act is amended
24 by changing Section 3-2 as follows:

2     Sec. 3-2. Identification number application. The owner of
3 each watercraft requiring numbering by this State shall file an

1     The registration surcharge shall be deposited into the
2 Conservation Police Vehicle Fund.
3     Upon receipt of the application in approved form, and when
4 satisfied that no tax imposed pursuant to the "Municipal Use
5 Tax Act" or the "County Use Tax Act" is owed, or that such tax
6 has been paid, the Department shall enter the same upon the
7 records of its office and issue to the applicant a certificate
8 of number stating the number awarded to the watercraft and the
9 name and address of the owner.
