AMENDMENT TO SENATE BILL 2009

2     AMENDMENT NO. ______. Amend Senate Bill 2009, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Public University Energy Conservation Act
6 is amended by changing Section 5-10 as follows:
 
7     (110 ILCS 62/5-10)
8     Sec. 5-10. Energy conservation measure.
9     (a) "Energy conservation measure" means any improvement,
10 repair, alteration, or betterment of any building or facility,
11 subject to all applicable building codes, owned or operated by
12 a public university or any equipment, fixture, or furnishing to
13 be added to or used in any such building or facility that is
14 designed to reduce energy consumption or operating costs, and
15 may include, without limitation, one or more of the following:
16         (1) Insulation of the building structure or systems

1     within the building.
2         (2) Storm windows or doors, caulking or
3     weatherstripping, multiglazed windows or doors, heat
4     absorbing or heat reflective glazed and coated window or
5     door systems, additional glazing, reductions in glass
6     area, or other window and door system modifications that
7     reduce energy consumption.
8         (3) Automated or computerized energy control systems.
9         (4) Heating, ventilating, or air conditioning system
10     modifications or replacements.
11         (5) Replacement or modification of lighting fixtures
12     to increase the energy efficiency of the lighting system
13     without increasing the overall illumination of a facility,
14     unless an increase in illumination is necessary to conform
15     to the applicable State or local building code for the
16     lighting system after the proposed modifications are made.
17         (6) Energy recovery systems.
18         (7) Energy conservation measures that provide
19     long-term operating cost reductions.
20     (b) From the effective date of this amendatory Act of the
21 96th General Assembly until January 1, 2015, "energy
22 conservation measure" includes a renewable energy center pilot
23 project at Eastern Illinois University, provided that:
24         (1) the University signs a partnership contract with a
25     qualified energy conservation measure provider as provided
26     in this Act;

1         (2) the University has responsibility for the
2     qualified provider's actions with regard to applicable
3     laws;
4         (3) the University obtains a performance bond in
5     accordance with this Act;
6         (4) the University and the qualified provider follow
7     all aspects of the Prevailing Wage Act as provided by this
8     Act;
9         (5) the University and the qualified provider use an
10     approved list of firms from the Capital Development Board
11     (CDB), unless the University requires services that are not
12     typically performed by the firms on CDB's list;
13         (6) the University provides monthly progress reports
14     to the Procurement Policy Board, and the University allows
15     a representative from CDB to monitor the project, provided
16     that such involvement is at no cost to the University;
17         (7) the University requires the qualified provider to
18     follow the provisions of the Business Enterprise for
19     Minorities, Females, and Persons with Disabilities Act and
20     the Public Works Employment Discrimination Act as provided
21     in this Act;
22         (8) the University agrees to award new building
23     construction work to a responsible bidder, as defined in
24     Section 30-22 of the Illinois Procurement Code;
25         (9) the University includes in its contract with the
26     qualified provider a requirement that the qualified

1     provider name the sub-contractors that it will use, and the
2     qualified provider may not change these without the
3     University's written approval;
4         (10) the University follows, to the extent possible,
5     the Design-Build Procurement Act for construction of the
6     project, taking into consideration the current status of
7     the project; for purposes of this Act, the definition of
8     "State construction agency" in the Design-Build
9     Procurement Act means Eastern Illinois University for the
10     purpose of this project;
11         (11) the University follows, to the extent possible,
12     the Architectural, Engineering, and Land Surveying
13     Qualifications Based Selection Act;
14         (12) the University requires all engineering,
15     architecture, and design work related to the installation
16     or modification of facilities be performed by design
17     professionals licensed by the State of Illinois and
18     professional design firms registered in the State of
19     Illinois; and
20         (13) the University produces annual reports and a final
21     report describing the project upon completion and files the
22     reports with the Procurement Policy Board, CDB, and the
23     General Assembly.
24     The provisions of this subsection (b), other than this
25 sentence, are inoperative after January 1, 2015.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.".
