AMENDMENT TO SENATE BILL 2009

2     AMENDMENT NO. ______. Amend Senate Bill 2009, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Public University Energy Conservation Act
6 is amended by changing Section 5-10 as follows:
 
7     (110 ILCS 62/5-10)
8     Sec. 5-10. Energy conservation measure.
9     (a) "Energy conservation measure" means any improvement,
10 repair, alteration, or betterment of any building or facility,
11 subject to all applicable building codes, owned or operated by
12 a public university or any equipment, fixture, or furnishing to
13 be added to or used in any such building or facility that is
14 designed to reduce energy consumption or operating costs, and
15 may include, without limitation, one or more of the following:
16         (1) Insulation of the building structure or systems

1     within the building.
2         (2) Storm windows or doors, caulking or
3     weatherstripping, multiglazed windows or doors, heat
4     absorbing or heat reflective glazed and coated window or
5     door systems, additional glazing, reductions in glass
6     area, or other window and door system modifications that
7     reduce energy consumption.
8         (3) Automated or computerized energy control systems.
9         (4) Heating, ventilating, or air conditioning system
10     modifications or replacements.
11         (5) Replacement or modification of lighting fixtures
12     to increase the energy efficiency of the lighting system
13     without increasing the overall illumination of a facility,
14     unless an increase in illumination is necessary to conform
15     to the applicable State or local building code for the
16     lighting system after the proposed modifications are made.
17         (6) Energy recovery systems.
18         (7) Energy conservation measures that provide
19     long-term operating cost reductions.
20     (b) Until January 1, 2015, "energy conservation measure"
21 includes a renewable energy center pilot project at Eastern
22 Illinois University, provided that:
23         (1) the University signs a partnership contract with
24     the energy conservation measure provider as provided in the
25     Public University Energy Conservation Act;
26         (2) the University has joint responsibility for the

1     contractor's actions with regard to applicable laws;
2         (3) the University obtains a performance bond to
3     guarantee the energy savings in accordance with the Public
4     University Energy Conservation Act;
5         (4) the University and the partnership entity follow
6     all aspects of the Prevailing Wage Act as provided by the
7     Public University Energy Conservation Act;
8         (5) the University and the contractor use an approved
9     subcontractor list from the Capital Development Board
10     (CDB), unless the University needs work done that is not
11     typically done by the subcontractors on CDB's list;
12         (6) the University shall allow a representative from
13     CDB to monitor the project provided that such CDB
14     involvement is at no cost to the University; and
15         (7) the University requires the contractor to follow
16     the provisions of the Business Enterprise for Minorities,
17     Females, and Persons with Disabilities Act and the Public
18     Works Employment Discrimination Act as provided in the
19     Public University Energy Conservation Act.
20     The provisions of this subsection (b), other than this
21 sentence, are inoperative after January 1, 2015.
