AMENDMENT TO SENATE BILL 1769

2     AMENDMENT NO. ______. Amend Senate Bill 1769 as follows:
 
3 on page 1, lines 10 and 11, by replacing "that he or she
4 manages" with "under his or her supervision"; and
 
5 on page 2, lines 5 and 6, by replacing "that he or she manages"
6 with "under his or her supervision"; and
 
7 on page 2, by inserting the following immediately below line
8 17:
 
9     "Section 12. The Child Care Act of 1969 is amended by
10 changing Section 5.6 as follows:
 
11     (225 ILCS 10/5.6)
12     Sec. 5.6. Pesticide and lawn care product application at
13 day care centers.

1     (a) Licensed day care centers shall abide by the
2 requirements of Sections 10.2 and 10.3 of the Structural Pest
3 Control Act.
4     (b) Notification required pursuant to Section 10.3 of the
5 Structural Pest Control Act may not be given more than 30 days
6 before the application of the pesticide.
7     (c) Each licensed day care center, subject to the
8 requirements of Section 10.3 of the Structural Pest Control
9 Act, must ensure that pesticides will not be applied when
10 children are present at the center. Toys and other items
11 mouthed or handled by the children must be removed from the
12 area before pesticides are applied. Children must not return to
13 the treated area within 2 hours after a pesticide application
14 or as specified on the pesticide label, whichever time is
15 greater.
16     (d) The owners and operators of licensed day care centers
17 must ensure (i) that lawn care products will not be applied to
18 day care center grounds when children are present at the center
19 or on its grounds and (ii) that children at the center will not
20 be able to access day care center grounds that have been
21 treated with lawn care products for at least 12 hours after
22 those grounds are treated with a lawn care product. Toys and
23 other items mouthed or handled by children must be removed from
24 the grounds before lawn care products are applied. For the
25 purpose of this Section, "lawn care product" has the same
26 meaning as that term is defined in the Lawn Care Products

3 on page 7, line 26, by replacing "customer," with "customer or
4 any person whose property abuts or is adjacent to the property
5 of a customer of an applicator for hire"; and
 
6 on page 8, line 1, immediately following "sheet", by inserting
7 "and approved pesticide registration label"; and
 
8 on page 10, line 19, immediately following "correspondence", by
9 inserting ", but posting on a bulletin board is not
10 sufficient"; and
 
11 on page 10, line 21, by replacing "2" with "4 2"; and
 
12 on page 11, lines 20 and 21, by replacing "natural lawn care
13 program" with "pesticide-free turf care program".
