1     AN ACT concerning voter registration.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Identification Card Act is amended
5 by adding Section 5.5 as follows:
 
6     (15 ILCS 335/5.5 new)
7     Sec. 5.5. Voter registration. All applicants who will be at
8 least 18 years of age at the next election and who appear at a
9 Secretary of State driver services facility for the issuance of
10 an original, duplicate, corrected, or renewal identification
11 card shall be asked if they wish to apply to register to vote.
12 It shall be the responsibility of the applicant to determine
13 whether the applicant is otherwise legally eligible to register
14 to vote. Applicants who apply to register to vote shall
15 complete a voter registration application, which the Secretary
16 shall forward to the appropriate local election authority.
17 Applicants who do not wish to apply to register to vote shall
18 sign a declination statement. The Secretary shall maintain a
19 database of all persons who complete voter registration
20 applications at driver services facilities.
 
21     Section 10. The Illinois Vehicle Code is amended by
22 changing Section 2-105 as follows:

2     Sec. 2-105. Offices of Secretary of State.
3     (a) The Secretary of State shall maintain offices in the
4 State capital and in such other places in the State as he may
5 deem necessary to properly carry out the powers and duties
6 vested in him.
7     (b) The Secretary of State may construct and equip one or
8 more buildings in the State of Illinois outside of the County
9 of Sangamon as he deems necessary to properly carry out the
10 powers and duties vested in him. The Secretary of State may, on
11 behalf of the State of Illinois, acquire public or private
12 property needed therefor by lease, purchase or eminent domain.
13 The care, custody and control of such sites and buildings
14 constructed thereon shall be vested in the Secretary of State.
15 Expenditures for the construction and equipping of any of such
16 buildings upon premises owned by another public entity shall
17 not be subject to the provisions of any State law requiring
18 that the State be vested with absolute fee title to the
19 premises. The exercise of the authority vested in the Secretary
20 of State by this Section is subject to the appropriation of the
21 necessary funds.
22     (c) All applicants who will be at least 18 years of age at
23 the next election and who appear at a Secretary of State driver
24 services facility for the issuance of an original, duplicate,
25 corrected, or renewal driver's license, except for applicants

1 for a temporary visitor's driver's license, shall be asked if
2 they wish to apply to register to vote. It shall be the
3 responsibility of the applicant to determine whether the
4 applicant is otherwise legally eligible to register to vote.
5 Applicants who apply to register to vote shall complete a voter
6 registration application, which the Secretary shall forward to
7 the appropriate local election authority. Applicants who do not
8 wish to apply to register to vote shall sign a declination
9 statement. The Secretary shall maintain a database of all
10 persons who complete voter registration applications at driver
11 services facilities. Pursuant to Sections 4-6.2, 5-16.2, and
12 6-50.2 of the Election Code, the Secretary of State shall make
13 driver services facilities available for use as temporary
14 places of registration. Registration within the offices shall
15 be in the most public, orderly and convenient portions thereof,
16 and Section 4-3, 5-3, and 11-4 of the Election Code relative to
17 the attendance of police officers during the conduct of
18 registration shall apply. Registration under this Section
19 shall be made in the manner provided by Sections 4-8, 4-10,
20 5-7, 5-9, 6-34, 6-35, and 6-37 of the Election Code.
21     (d) (Blank). Within 30 days after the effective date of
22 this amendatory Act of 1990, and no later than November 1 of
23 each even-numbered year thereafter, the Secretary of State, to
24 the extent practicable, shall designate to each election
25 authority in the State a reasonable number of employees at each
26 driver services facility registered to vote within the

1 jurisdiction of such election authority and within adjacent
2 election jurisdictions for appointment as deputy registrars by
3 the election authority located within the election
4 jurisdiction where the employees maintain their residences.
5 Such designation shall be in writing and certified by the
6 Secretary of State.
7     (e) (Blank). Each person applying at a driver services
8 facility for a driver's license or permit, a corrected driver's
9 license or permit, an Illinois identification card or a
10 corrected Illinois identification card shall be notified that
11 the person may register at such station to vote in the State
12 and may also transfer his voter registration at such station to
13 a different address in the State. Such notification may be made
14 in writing or verbally issued by an employee or the Secretary
15 of State.
16     The Secretary of State shall promulgate such rules as may
17 be necessary for the efficient execution of his duties and the
18 duties of his employees under this amendatory Act of 1990.
19     (f) Any person applying at a driver services facility for
20 issuance or renewal of a driver's license or Illinois
21 Identification Card shall be provided, without charge, with a
22 brochure warning the person of the dangers of financial
23 identity theft. The Department of Financial and Professional
24 Regulation shall prepare these brochures and provide them to
25 the Secretary of State for distribution. The brochures shall
26 (i) identify signs warning the reader that he or she might be

1 an intended victim of the crime of financial identity theft,
2 (ii) instruct the reader in how to proceed if the reader
3 believes that he or she is the victim of the crime of identity
4 theft, and (iii) provide the reader with names and telephone
5 numbers of law enforcement and other governmental agencies that
6 provide assistance to victims of financial identity theft.
