1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Educational Labor Relations Act is
5 amended by changing Section 4 as follows:
 
6     (115 ILCS 5/4)  (from Ch. 48, par. 1704)
7     Sec. 4. Employer rights. Employers shall not be required to
8 bargain over matters of inherent managerial policy, which shall
9 include such areas of discretion or policy as the the functions
10 of the employer, standards of services, its overall budget, the
11 organizational structure and selection of new employees and
12 direction of employees. Employers, however, shall be required
13 to bargain collectively with regard to policy matters directly
14 affecting wages, hours and terms and conditions of employment
15 as well as the impact thereon upon request by employee
16 representatives. To preserve the rights of employers and
17 exclusive representatives which have established collective
18 bargaining relationships or negotiated collective bargaining
19 agreements prior to the effective date of this Act, employers
20 shall be required to bargain collectively with regard to any
21 matter concerning wages, hours or conditions of employment
22 about which they have bargained for and agreed to in a
23 collective bargaining agreement prior to the effective date of
