HOUSE RESOLUTION

 
2     WHEREAS, The purpose of the Illinois Personnel Code is to
3 establish for the government of the State of Illinois a system
4 of personnel administration under the Governor, based on merit
5 principles and scientific methods; and
 
6     WHEREAS, All offices and positions of employment in the
7 service of the State of Illinois are subject to the provisions
8 of the Personnel Code unless exempted by law; and
 
9     WHEREAS, The Illinois Personnel Code establishes the
10 following jurisdictions: Jurisdiction A, with respect to the
11 classification and compensation of positions in the State
12 service; Jurisdiction B, with respect to the positions in the
13 State service to which persons must hold appointments on a
14 basis of merit and fitness; and Jurisdiction C, with respect to
15 conditions of employment in State service; and
 
16     WHEREAS, The Personnel Code provides for the partial or
17 total exemption of certain positions from provisions of the
18 Code pertaining to Jurisdictions A, B, and C; and
 
19     WHEREAS, The Civil Service Commission is authorized to
20 exempt from Jurisdiction B positions that in its judgment
21 involve either principal administrative responsibility for the

1 determination of policy or principal administrative
2 responsibility for the way in which policies are carried out,
3 upon written recommendation of the Director of Central
4 Management Services; and
 
5     WHEREAS, Positions exempted from the Personnel Code by the
6 Civil Service Commission typically involve upper-management
7 positions, subject to a higher pay range than non-exempt
8 positions, and may be filled without regard to veteran's
9 preference or the merit and fitness requirements (testing) of
10 the Code; and
 
11     WHEREAS, As of December 31, 2003, the number of exemptions
12 granted by the Civil Service Commission in executive branch
13 State agencies was 381; that number has consistently increased
14 in the past 6 years to an unprecedented number of 824; and
 
15     WHEREAS, A report recently released by the Executive Ethics
16 Commission indicates that exempt positions were used by State
17 agencies to circumvent veterans' preference requirements and
18 to hire unqualified persons into State positions; therefore, be
19 it
 
20     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
21 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
22 the Auditor General is directed to conduct an audit of

1 exemptions granted by the Civil Service Commission pursuant to
2 its authority under item (3) of subsection (d) of Section 4 of
3 the Illinois Personnel Code during the period January 1, 2003
4 to December 31, 2008, to determine if the granting of such
5 exemptions was consistent with applicable State law and rules;
6 and be it further
 
7     RESOLVED, That the Auditor General commence this audit as
8 soon as possible and report his findings and recommendations
9 upon completion in accordance with the provisions of the
10 Illinois State Auditing Act; and be it further
 
11     RESOLVED, That a copy of this resolution be delivered to
12 the Auditor General.
