AMENDMENT TO HOUSE BILL 5869

2     AMENDMENT NO. ______. Amend House Bill 5869, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Elder Abuse and Neglect Act is amended by
6 changing Section 3.5 as follows:
 
7     (320 ILCS 20/3.5)
8     Sec. 3.5. Other Responsibilities. The Department shall
9 also be responsible for the following activities, contingent
10 upon adequate funding:
11     (a) promotion of a wide range of endeavors for the purpose
12 of preventing elder abuse, neglect, financial exploitation,
13 and self-neglect in both domestic and institutional settings,
14 including, but not limited to, promotion of public and
15 professional education to increase awareness of elder abuse,
16 neglect, financial exploitation, and self-neglect, to increase

1 reports, and to improve response by various legal, financial,
2 social, and health systems;
3     (b) coordination of efforts with other agencies, councils,
4 and like entities, to include but not be limited to, the Office
5 of the Attorney General, the State Police, the Illinois Law
6 Enforcement Training Standards Board, the State Triad, the
7 Illinois Criminal Justice Information Authority, the
8 Departments of Public Health, Public Aid, and Human Services,
9 the Family Violence Coordinating Council, the Illinois
10 Violence Prevention Authority, and other entities which may
11 impact awareness of, and response to, elder abuse, neglect,
12 financial exploitation, and self-neglect;
13     (c) collection and analysis of data;
14     (d) monitoring of the performance of regional
15 administrative agencies and elder abuse provider agencies;
16     (e) promotion of prevention activities;
17     (f) establishing and coordinating an aggressive training
18 program on the unique nature of elder abuse cases with other
19 agencies, councils, and like entities, to include but not be
20 limited to the Office of the Attorney General, the State
21 Police, the Illinois Law Enforcement Training Standards Board,
22 the State Triad, the Illinois Criminal Justice Information
23 Authority, the State Departments of Public Health, Public Aid,
24 and Human Services, the Family Violence Coordinating Council,
25 the Illinois Violence Prevention Authority, and other entities
26 that may impact awareness of and response to elder abuse,

1 neglect, financial exploitation, and self-neglect;
2     (g) (Blank) solicitation of financial institutions for the
3 purpose of making information available to the general public
4 warning of financial exploitation of the elderly and related
5 financial fraud or abuse, including such information and
6 warnings available through signage or other written materials
7 provided by the Department on the premises of such financial
8 institutions, provided that the manner of displaying or
9 distributing such information is subject to the sole discretion
10 of each financial institution; and
11     (g-1) providing financial institutions with training
12 materials and information concerning financial exploitation of
13 the elderly and related financial fraud or abuse to be used by
14 a financial institution for its personnel with direct customer
15 contact and to be made available to the general public; such
16 information shall include signage or other written materials
17 and shall contain relevant toll-free telephone numbers for
18 reporting such fraud or abuse; the Department shall also
19 develop and make available an online training program for use
20 by financial institution employees with direct customer
21 contact; such online training shall be utilized by financial
22 institutions unless such financial institutions utilize
23 training programs which must minimally include the elements
24 contained in the Department on Aging Program; and
25     (h) coordinating efforts with utility and electric
26 companies to send notices in utility bills to explain to

1 persons 60 years of age or older their rights regarding
2 telemarketing and home repair fraud.
