SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-27 new
405 ILCS 30/4.8 new

    Amends the Community Services Act and the Medical Assistance Article of the Illinois Public Aid Code. Provides that after the effective date of this amendatory Act, community Medicaid mental health services provided by community-based providers shall no longer be included in contracts with the Department of Human Services; instead, community Medicaid mental health services provided by a community-based provider must be billed directly to the Department of Healthcare and Family Services and must be separate from contracts between the Department of Human Services and community-based providers for all other mental health services. Further provides that rates of reimbursement for community Medicaid mental health services shall be consistent with rates outlined in specified provisions of the Illinois Administrative Code. Effective July 1, 2011.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-27 as follows:
 
6     (305 ILCS 5/5-27 new)
7     Sec. 5-27. Payments for community Medicaid mental health
8 services.
9     (a) After the effective date of this amendatory Act of the
10 96th General Assembly, community Medicaid mental health
11 services provided by community-based providers shall no longer
12 be included in contracts with the Department of Human Services.
13 Instead, community Medicaid mental health services provided by
14 a community-based provider must be billed directly to the
15 Department of Healthcare and Family Services and must be
16 separate from contracts between the Department of Human
17 Services and community-based providers for all other mental
18 health services. Rates of reimbursement for community Medicaid
19 mental health services shall be consistent with rates outlined
20 in Section 132 of Title 59 of the Illinois Administrative Code.
21     (b) For purposes of this Section:
22     "Community Medicaid mental health services" means all
23 mental health services outlined in Section 132 of Title 59 of

1 the Illinois Administrative Code that are Medicaid funded and
2 provided by a community-based provider.
3     "Community-based provider" means an entity enrolled as a
4 provider pursuant to Sections 140.11 and 140.12 of Title 89 of
5 the Illinois Administrative Code and certified to provide
6 community Medicaid mental health services in accordance with
7 Section 132 of Title 59 of the Illinois Administrative Code.
 
8     Section 10. The Community Services Act is amended by adding
9 Section 4.8 as follows:
 
10     (405 ILCS 30/4.8 new)
11     Sec. 4.8. Payments for community Medicaid mental health
12 services.
13     (a) After the effective date of this amendatory Act of the

1     (b) For purposes of this Section:

4 the Illinois Administrative Code that are Medicaid funded and

11     Section 99. Effective date. This Act takes effect July 1,
12 2011.
