    Amends the Downstate Public Transportation Act, Metropolitan Transit Authority Act, Local Mass Transit District Act, and Regional Transportation Authority Act. Requires that seniors must be aged 65 or older, as well as eligible for benefits under the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act, to receive free service. Provides that the requirement must be imposed no later than 180 days after the effective date of the amendatory Act. Provides that the Department of Aging shall furnish all information necessary to establish eligibility for free service. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Downstate Public Transportation Act is
5 amended by changing Section 2-15.2 as follows:
 
6     (30 ILCS 740/2-15.2)
7     Sec. 2-15.2. Free services; eligibility.
8     (a) Notwithstanding any law to the contrary, no later than
9 60 days following the effective date of this amendatory Act of
10 the 95th General Assembly and until subsection (b) is
11 implemented, any fixed route public transportation services
12 provided by, or under grant or purchase of service contracts
13 of, every participant, as defined in Section 2-2.02 (1)(a),
14 shall be provided without charge to all senior citizen
15 residents of the participant aged 65 and older, under such
16 conditions as shall be prescribed by the participant.
17     (b) Notwithstanding any law to the contrary, no later than
18 180 days following the effective date of this amendatory Act of
19 the 96th General Assembly, any fixed route public
20 transportation services provided by, or under grant or purchase
21 of service contracts of, every participant, as defined in
22 Section 2-2.02 (1)(a), shall be provided without charge only to
23 senior citizens aged 65 and older who meet the income

1 eligibility limitation set forth in subsection (a-5) of Section
2 4 of the Senior Citizens and Disabled Persons Property Tax
3 Relief and Pharmaceutical Assistance Act, under such
4 conditions as shall be prescribed by the participant. The
5 Department on Aging shall furnish all information reasonably
6 necessary to determine eligibility, including updated lists of
7 individuals who are eligible for services without charge under
8 this Section. Nothing in this Section shall relieve the
9 participant from providing reduced fares as may be required by
10 federal law.

12     Section 10. The Metropolitan Transit Authority Act is
13 amended by changing Section 51 as follows:

15     Sec. 51. Free services; eligibility.
16     (a) Notwithstanding any law to the contrary, no later than
17 60 days following the effective date of this amendatory Act of
18 the 95th General Assembly and until subsection (b) is
19 implemented, any fixed route public transportation services
20 provided by, or under grant or purchase of service contracts
21 of, the Board shall be provided without charge to all senior
22 citizens of the Metropolitan Region (as such term is defined in
23 70 ILCS 3615/1.03) aged 65 and older, under such conditions as
24 shall be prescribed by the Board.

1     (b) Notwithstanding any law to the contrary, no later than
2 180 days following the effective date of this amendatory Act of
3 the 96th General Assembly, any fixed route public
4 transportation services provided by, or under grant or purchase

6 charge only to senior citizens aged 65 and older who meet the
7 income eligibility limitation set forth in subsection (a-5) of

17     Section 15. The Local Mass Transit District Act is amended
18 by changing Section 8.6 as follows:

21     (a) Notwithstanding any law to the contrary, no later than
22 60 days following the effective date of this amendatory Act of
23 the 95th General Assembly and until subsection (b) is

2 of, every District shall be provided without charge to all
3 senior citizens of the District aged 65 and older, under such
4 conditions as shall be prescribed by the District.
5     (b) Notwithstanding any law to the contrary, no later than
6 180 days following the effective date of this amendatory Act of
7 the 96th General Assembly, any fixed route public
8 transportation services provided by, or under grant or purchase
9 of service contracts of, every District shall be provided
10 without charge only to senior citizens aged 65 and older who
11 meet the income eligibility limitation set forth in subsection
12 (a-5) of Section 4 of the Senior Citizens and Disabled Persons
13 Property Tax Relief and Pharmaceutical Assistance Act, under
14 such conditions as shall be prescribed by the District. The
15 Department on Aging shall furnish all information reasonably
16 necessary to determine eligibility, including updated lists of
17 individuals who are eligible for services without charge under
18 this Section. Nothing in this Section shall relieve the
19 District from providing reduced fares as may be required by
20 federal law.

22     Section 20. The Regional Transportation Authority Act is
23 amended by changing Sections 3A.15 and 3B.14 as follows:

2     (a) Notwithstanding any law to the contrary, no later than
3 60 days following the effective date of this amendatory Act of
4 the 95th General Assembly and until subsection (b) is
5 implemented, any fixed route public transportation services
6 provided by, or under grant or purchase of service contracts
7 of, the Suburban Bus Board shall be provided without charge to
8 all senior citizens of the Metropolitan Region aged 65 and
9 older, under such conditions as shall be prescribed by the
10 Suburban Bus Board.
11     (b) Notwithstanding any law to the contrary, no later than
12 180 days following the effective date of this amendatory Act of
13 the 96th General Assembly, any fixed route public
14 transportation services provided by, or under grant or purchase
15 of service contracts of, the Suburban Bus Board shall be
16 provided without charge only to senior citizens aged 65 and
17 older who meet the income eligibility limitation set forth in
18 subsection (a-5) of Section 4 of the Senior Citizens and
19 Disabled Persons Property Tax Relief and Pharmaceutical
20 Assistance Act, under such conditions as shall be prescribed by
21 the Suburban Bus Board. The Department on Aging shall furnish
22 all information reasonably necessary to determine eligibility,
23 including updated lists of individuals who are eligible for
24 services without charge under this Section. Nothing in this
25 Section shall relieve the Suburban Bus Board from providing
26 reduced fares as may be required by federal law.

9 of, the Commuter Rail Board shall be provided without charge to

11 older, under such conditions as shall be prescribed by the
12 Commuter Rail Board.
13     (b) Notwithstanding any law to the contrary, no later than
14 180 days following the effective date of this amendatory Act of
15 the 96th General Assembly, any fixed route public
16 transportation services provided by, or under grant or purchase
17 of service contracts of, the Commuter Rail Board shall be
18 provided without charge only to senior citizens aged 65 and
19 older who meet the income eligibility limitation set forth in
20 subsection (a-5) of Section 4 of the Senior Citizens and
21 Disabled Persons Property Tax Relief and Pharmaceutical
22 Assistance Act, under such conditions as shall be prescribed by
23 the Commuter Rail Board. The Department on Aging shall furnish
24 all information reasonably necessary to determine eligibility,
25 including updated lists of individuals who are eligible for

5     Section 99. Effective date. This Act takes effect upon
6 becoming law.
