AMENDMENT TO HOUSE BILL 4245

2     AMENDMENT NO. ______. Amend House Bill 4245, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Alternate Fuels Act is amended by adding
6 Section 23 as follows:
 
7     (415 ILCS 120/23 new)
8     Sec. 23. Alternate Fuels Commission.
9     (a) The Alternate Fuels Commission is established within
10 the Department of Commerce and Economic Opportunity. The
11 Commission shall investigate and recommend strategies that the
12 Governor and the General Assembly may implement to promote the
13 use of alternate fuels and biodiesel fuels and to encourage the
14 use of vehicles that utilize alternate fuels and biodiesel
15 fuels. The Commission shall also identify mechanisms that
16 promote research into alternate fuels and biodiesel fuels.

1     (b) The Commission shall identify mechanisms that promote
2 effective communication and coordination of efforts between
3 this State and local governments, private industry, and
4 institutes of higher education concerning the investigation,
5 research into, and promotion of alternate fuels and biodiesel
6 fuels.
7     (c) The Commission may also review and recommend changes to
8 any State regulation that may hinder the use, research, and
9 development of alternate fuels, biodiesel fuels, and vehicles
10 that are able to utilize those fuels.
11     (d) The Commission shall consist of the following members,
12 appointed by the Governor within 90 days of the effective date
13 of this Act:
14         (1) The Director of Commerce and Economic Opportunity
15     (or his or her designee), who shall serve as the chair of
16     the Commission.
17         (2) The Director of Agriculture (or his or her
18     designee).
19         (3) At least one member from an association
20     representing corn growers.
21         (4) At least one member from an association
22     representing soybean producers.
23         (5) One representative of a general agricultural
24     production association.
25         (6) One representative of automotive fuel blenders in
26     this State.

1         (7) One representative of retail petroleum sellers in
2     this State.
3         (8) One representative of petroleum suppliers in this
4     State.
5         (9) One representative of biodiesel fuel producers.
6         (10) One representative of ethanol producers.
7         (11) One representative of environmental
8     organizations.
9         (12) Three representatives of the automotive
10     manufacturing industry.
11         (13) Three representatives of colleges and
12     universities in this State that are engaged in alternate
13     fuel or biodiesel fuel research.
14         (14) Any other member that the Governor concludes is
15     necessary to further the Commission's purposes.
16     (e) No later than one year after the effective date of this
17 amendatory Act of the 96th General Assembly, the Commission
18 shall issue a written report on its investigation and
19 recommendations to the General Assembly and the Governor.
20 Follow-up reports shall be issued at least annually and may be
21 issued more frequently if the Commission deems it advisable.
22     (f) This Section is repealed effective January 1, 2012.

24     Section 10. The Alternate Fuels Act is amended by repealing

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.".
