SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Renewable Fuels Commission Act to investigate and recommend strategies that the Governor and the General Assembly may implement to promote the use of alternative fuels and encourage the use of vehicles that utilize alternative fuels. Provides that the Commission shall also identify mechanisms that promote research into alternative fuels as well as effective communication and coordination of efforts between this State and local governments, private industry, and institutes of higher education concerning the investigation, research into, and promotion of alternative fuels. Specifies the Commission's membership. Requires the Commission to issue written reports on its investigations and recommendations to the General Assembly and the Governor. Provides for the repeal of this Act on January 1, 2015. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Renewable Fuels Commission Act.
 
6     Section 5. Definitions. As used in this act:
7     "Alternative fuel" means a fuel composed of biomass or
8 another fuel that does not have petroleum as a base or a blend
9 of a nonpetroleum-based fuel and a petroleum-based fuel.
10 Alternative fuel may include, but is not limited to, biodiesel
11 and ethanol.
12     "Biodiesel" means a fuel composed of mono-alkyl esters of
13 long chain fatty acids derived from vegetable oils or animal
14 fats and, in accordance with standards specified by the
15 American Society for Testing and Materials, designated B100,
16 and meeting the requirements of D-6751, as approved by the
17 Department.
18     "Biomass fuel" means a fuel made from plant material,
19 vegetation, or agricultural waste.
20     "Ethanol" means a substance that meets the American Society
21 for Testing and Materials standard in effect on the effective
22 date of this Act as the D-4806 specification for denatured fuel
23 grade ethanol for blending with gasoline.

1     Section 10. Renewable Fuels Commission.
2     (a) The Renewable Fuels Commission is established within
3 the Department of Agriculture. The Commission shall
4 investigate and recommend strategies that the Governor and the
5 General Assembly may implement to promote the use of
6 alternative fuels and encourage the use of vehicles that
7 utilize alternative fuels. The Commission shall also identify
8 mechanisms that promote research into alternative fuels.
9     (b) The Commission shall identify mechanisms that promote
10 effective communication and coordination of efforts between
11 this State and local governments, private industry, and
12 institutes of higher education concerning the investigation,
13 research into, and promotion of alternative fuels.
14     (c) The Commission may also review any State regulation
15 that may hinder the use, research, and development of
16 alternative fuels and vehicles that are able to utilize them
17 and recommend changes to the Governor.
 
18     Section 15. Commission membership. The Commission shall
19 consist of the following members, appointed by the Governor
20 within 90 days of the effective date of this Act:
21     (a) The Director of Agriculture (or his or her designee)
22 who shall serve as the chair of the Commission.
23     (b) The Director of Commerce and Economic Opportunity (or
24 his or her designee).

1     (c) One member representing the Department of Labor.
2     (d) At least one member from an association representing
3 corn growers.
4     (e) At least one member from an association representing
5 soybean producers.
6     (f) One representative of automotive fuel blenders in this
7 State.
8     (g) One representative of retail petroleum sellers in this
9 State.
10     (h) One representative of petroleum suppliers in this
11 State.
12     (i) One representative of biodiesel producers.
13     (j) One representative of ethanol producers.
14     (k) One representative of environmental organizations.
15     (l) Three representatives of the automotive manufacturing
16 industry.
17     (m) Three representatives of colleges and universities in
18 this State that are engaged in alternative fuel research.
19     (n) Any other member that the Governor concludes is
20 necessary to further the Commission's purposes.
 
21     Section 20. Commission reports. No later than one year
22 after the effective date of this Act, the Commission shall
23 issue a written report on its investigation and recommendations
24 to the General Assembly and the Governor. Follow-up reports
25 shall be issued at least annually and may be issued more

1 frequently if the Commission deems it advisable.
 
2     Section 95. Repeal date. This Act is repealed effective
3 January 1, 2015.
 
4     Section 99. Effective date. This Act takes effect upon
5 becoming law.
