AMENDMENT TO HOUSE BILL 3854

2     AMENDMENT NO. ______. Amend House Bill 3854, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 1. Short title. This Act may be cited as the
6 Carbon Capture and Sequestration Legislation Commission Act.
 
7     Section 5. Definitions. As used in this Act:
8     "CO2" means carbon dioxide.
9     "Commission" means the Carbon Capture and Sequestration
10 Legislation Commission.
11     "Director" means the Director of the Illinois Power Agency.
 
12     Section 10. Creation of the Carbon Capture and
13 Sequestration Legislation Commission.
14     (a) The Carbon Capture and Sequestration Legislation
15 Commission is created and shall consist of 11 members,

1 including the Director, who shall serve as the ex-officio
2 chairperson of the Commission.
3     (b) The remaining 10 members of the Commission shall be
4 appointed as follows:
5         (1) one member shall be appointed by the Speaker of the
6     House of Representatives;
7         (2) one member shall be appointed by the President of
8     the Senate;
9         (3) one member shall be appointed by the Minority
10     Leader of the House of Representatives;
11         (4) one member shall be appointed by the Minority
12     Leader of the Senate;
13         (5) one member shall be the Chairperson of the Illinois
14     Commerce Commission, or his or her designee; and
15         (5) 5 members shall be appointed by the Governor.
16     (c) The appointments made by the Governor shall include one
17 member with legal expertise, one member with engineering
18 expertise, one member with financial expertise, one member
19 representing the employer community, and one member
20 representing the environmental community.
21     (d) The Director may retain services from outside parties
22 with legal, engineering, and financial expertise to assist the
23 Commission in carrying out its duties.
24     (e) The Illinois Commerce Commission may assist the
25 Director in staffing and administering the Commission.
26     (f) Commission members are not eligible to receive

1 compensation or reimbursement of expenses.
 
2     Section 15. Report on carbon capture and sequestration
3 legislation.(a) The Commission shall file a report no later
4 than December 31, 2010 with the General Assembly on all issues
5 deemed appropriate to carbon capture and sequestration
6 legislation, including, but not limited to, the following:
7         (1) Ownership of the CO2.
8         (2) Liability for release of CO2.
9         (3) Acquisition and ownership of pore space.
10         (4) Procedures and safeguards for the transportation
11     and sequestration of CO2.
12         (5) Methodology to establish any necessary fees,
13     costs, or offsets.
14         (6) Potential use of CO2.
15         (7) Construction of pipelines.
16         (8) Coordination with applicable federal law or
17     regulatory commissions.
18     (b) The Commission shall be abolished upon filing its
19 report with the General Assembly.
 
20     Section 20. Repealer. This Act is repealed on January 1,
21 2011.
 
22     Section 99. Effective date. This Act takes effect upon
23 becoming law.".
