1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Green Governments Illinois Act is amended by
5 changing Sections 15, 20, and 35 as follows:

7     Sec. 15. Composition of the Council. The Council shall be
8 comprised of representatives from various State agencies and
9 State universities with specific fiscal, procurement,
10 educational, and environmental policy expertise. The
11 Lieutenant Governor is the chair of the Council. The director
12 or President, respectively, of each of the following State
13 agencies and State universities, or his or her designee, is a
14 member of the Council: the Department of Commerce and Economic
15 Opportunity, the Environmental Protection Agency, the
16 University of Illinois, ; the Department of Natural Resources,,
17 the Department of Central Management Services, the Governor's
18 Office of Management and Budget, the Department of Agriculture,
19 the Department of Transportation, the Department of
20 Corrections, the Department of Human Services, the Department
21 of Public Health, the State Board of Education, the Board of
22 Higher Education, and the Capital Development Board. The Office
23 of the Lieutenant Governor shall provide administrative

1 support to the Council. A minimum of one staff position in the
2 Office of the Lieutenant Governor shall be dedicated to the
3 Green Governments Illinois program.

7     Sec. 20. Responsibilities of the Council. The Council is
8 responsible for the development and dissemination of programs,
9 plans, and policies to reduce the environmental footprint of
10 State government and for improving the implementation of
11 greening the government initiatives in other institutions,
12 thereby reducing costs to taxpayers and improving efficiency in
13 operations. The Council shall convene on a quarterly basis and
14 shall be responsible for the following:
15         (a) Establishing long-term environmental
16     sustainability goals that the State will strive to achieve
17     within a period of 3, 5, and 10 years to improve the energy
18     and environmental performance of State buildings,
19     consistent with efficiency and economic objectives. These
20     goals shall, at a minimum, include the following:
21     broad-based performance goals for energy efficiency; use
22     of renewable fuels; water conservation; green purchasing;
23     paper consumption; and solid waste generation. These goals
24     can be met through increased efficiency, operational
25     changes, and improved maintenance and use of

1     cost-effective alternative technologies, raw materials,
2     and fuels.
3         The Council shall:
4             (1) communicate the environmental sustainability
5         goals to all State agencies;
6             (2) establish an electronic system to track and
7         report on environmental progress;
8             (3) monitor improvement activities; and
9             (4) propose new goals as appropriate.
10         (b) Coordinating an awards program that recognizes
11     units of State and local government and educational
12     institutions for developing, adopting, and implementing
13     innovative or exemplary environmental sustainability plans
14     in conformance with this Act.
15         (c) Creating specific guidance materials for State
16     agencies, educational institutions, and units of local
17     government on how to integrate environmental
18     sustainability into existing management systems, planning,
19     and operational practices, while still providing necessary
20     services and ensuring efficient and effective operations.
21     These guidance materials must include a list of
22     environmental and energy best practices, case studies,
23     policy language, model plans, and other resource
24     information. These materials must be made available on a
25     website devoted to the Green Governments Illinois program.
26         (d) Developing and implementing, to the extent

1     fiscally feasible, training programs designed to instill
2     the importance and value of environmental sustainability.
3         (e) Providing new ways for State government to build
4     markets for environmentally preferable products and
5     services without compromising price, competition, and
6     availability. The Council shall initially focus on
7     integrated pest management, bio-based products, recycled
8     content paper, energy efficiency, renewable energy,
9     alternative fuel vehicles, and green cleaning supplies.
10     Within existing resources, and within 60 days after the
11     effective date of this amendatory Act of the 96th General
12     Assembly, the Department of Central Management Services,
13     with the approval of the council, shall designate a single
14     point of contact for State agencies, suppliers, and other
15     interested parties to contact regarding environmentally
16     preferable purchasing issues.
17         (f) Working collaboratively with State agencies, units
18     of local government, educational institutions, and the
19     legislative branches of government to promote
20     benchmarking, commissioning, and retro-commissioning to
21     make government and institutional buildings more
22     resource-efficient, energy efficient, and healthful public
23     places.
24         (g) Reviewing budgetary policy and making
25     recommendations to the Governor on incentives for State
26     agencies to undertake environmental improvements that

1     result in long-term cost-savings, productivity
2     enhancements, or other outcomes deemed appropriate to the
3     State's sustainability goals.
4         (h) Reporting annually to the Governor and the General
5     Assembly on the results of environmental sustainability
6     actions taken by State agencies, educational institutions
7     and units of local government during the prior fiscal
8     calendar year. The report must include the environmental
9     and economic benefits of the environmental sustainability
10     actions, where feasible, the consumption of those actions,
11     and provide recommendations for future environmental
12     improvement activities during the following year. The
13     report shall be filed by September 1, 2008, and November
14     September 1 of each subsequent year.
15         (h-5) Participating in the proposal review and
16     subgrant award processes conducted by the Department of
17     Commerce and Economic Opportunity to distribute the
18     portion of funds eligible for State government use under
19     the federal Energy Independence and Security Act of 2007,
20     H.R. 6, Title V, Subtitle E (Energy Efficiency and
21     Conservation Block Grants). A designee of the Governor
22     shall also participate in these processes, and no subgrant
23     may be awarded unless the Governor's designee first
24     approves that subgrant.
25         (i) The chairman of the Council shall determine whether
26     or not the I-Cycle program is operating effectively and

1     make recommendations concerning management of the I-Cycle
2     program. The chairman has the authority to dissolve the
3     I-Cycle program if the program is found to be ineffective.

6     Sec. 35. Environmental Plans and Reporting.
7     (a) Each State agency shall submit an adopted environmental
8 sustainability plan to the chairman of the Council for review
9 and approval on or before April 1, 2008 November 1, 2007.
10     On or before November August 1, 2007, the Council shall
11 prepare a downloadable plan template designed to provide a
12 simple framework for the development of an environmental
13 sustainability plan as required by this Act. The Council shall
14 adopt procedures for reviewing and approving the plans, and
15 make staff available during preparation of the plans to assist
16 State agencies with their plan-writing efforts. The Council
17 shall complete its plan review process on or before June
18 January 1, 2008. The sustainability plans shall be reviewed and
19 updated periodically, but at least once every 3 years. Units To
20 the extent feasible and cost-effective, units of local
21 government and , educational institutions, and State agencies
22 are encouraged to submit adopt and implement similar
23 sustainability plans. Environmental sustainability plans may
24 be submitted to the chairman of the Council, by request, for
25 review and approval.

1     (b) On or before January 1, 2008 August 1, 2007, each State
2 agency, using existing resources, shall form an internal
3 environmental sustainability committee. The environmental
4 sustainability committee shall (i) assess the environmental
5 and resource use impacts of its major operational activities
6 making environmental improvements, conserving resources, and
7 reducing health risks; (ii) develop an environmental
8 sustainability plan as required under this Act; and (iii)
9 establish an ongoing process through which their
10 sustainability efforts can be reviewed and improved upon. The
11 committee shall focus on the most significant environmental and
12 resource use impacts, examine the feasibility and
13 cost-effectiveness of addressing these impacts, and prioritize
14 their actions accordingly.
15     Where feasible, the committee shall quantify the specific
16 impacts of major operational activities such as gallons of
17 water used, pounds of solid waste generated, gallons of
18 gasoline consumed, and dollars spent per year on electricity.
19 The committee shall consist of representatives from different
20 departments and program areas, including purchasing,
21 maintenance, and facility management. A senior member of
22 management shall be designated to coordinate environmental
23 sustainability efforts of each committee. The coordinator
24 shall provide information to agency facilities and staff,
25 coordinate planning and reporting activities, and act as
26 liaison to the Council. Where appropriate, State agencies may

1 appoint facility coordinators in addition to the agency
2 coordinator. Coordinators shall be given full management
3 support and provided with the necessary resources to meet the
4 goals of this Act.
5     (c) On or before July April 1, 2008 and on or before
6 September April 1 of each subsequent year, each State agency
7 shall submit to the chairman of the Council a report
8 summarizing the progress made in implementing its
9 environmental sustainability plan, including sustainability
10 measures adopted and goals achieved. The information in this
11 report shall encompass the previous fiscal calendar year.
12     On or before June January 1, 2008, the Council shall
13 develop and adopt a reporting form to be used to comply with
14 the provisions of this Section. Participating units of local
15 government, State agencies, and educational institutions are
16 encouraged to must submit an annual progress report on or
17 before September June 1, 2008 and on or before June 1 of each
18 subsequent year.
19     (d) State agencies shall be invited to participate in the
20 Council's efforts to foster environmental sustainability
21 practices throughout State government.
22     (e) The Council shall provide technical assistance to State
23 agencies, units of local government, and educational
24 institutions for the purpose of implementing the environmental
25 sustainability planning requirement.
26     (f) The Council may establish criteria for exempting select

1 State agencies from the environmental sustainability planning
2 based on staff size, probable environmental impacts, and scope
3 of operations.

5     Section 99. Effective date. This Act takes effect upon
6 becoming law.
