AMENDMENT TO HOUSE BILL 649

2     AMENDMENT NO. ______. Amend House Bill 649 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Emergency Medical Treatment Act is amended
5 by changing Section 1 as follows:
 
6     (210 ILCS 70/1)  (from Ch. 111 1/2, par. 6151)
7     Sec. 1. No hospital, physician, dentist or other provider
8 of professional health care licensed under the laws of this
9 State may refuse to provide needed emergency treatment to any
10 person whose life would be threatened in the absence of such
11 treatment, because of that person's inability to pay therefor,
12 nor because of the source of any payment promised therefor.
13 Every hospital licensed under the Hospital Licensing Act shall
14 comply with the Hospital Emergency Service Act.

1     Section 10. The Hospital Emergency Service Act is amended
2 by changing Section 1 as follows:
 
3     (210 ILCS 80/1)  (from Ch. 111 1/2, par. 86)
4     Sec. 1. Every hospital required to be licensed by the
5 Department of Public Health pursuant to the Hospital Licensing
6 Act which provides general medical and surgical hospital
7 services shall provide a hospital emergency service in
8 accordance with rules and regulations adopted by the Department
9 of Public Health which shall be consistent with the federal
10 Emergency Medical Treatment and Active Labor Act (42 U.S.C.
11 1395dd) and shall furnish such hospital emergency services to
12 any applicant who applies for the same in case of injury or
13 acute medical condition where the same is liable to cause death
14 or severe injury or serious illness. For purposes of this Act,
15 "applicant" includes any person who is brought to a hospital by
16 ambulance or specialized emergency medical services vehicle as
17 defined in the Emergency Medical Services (EMS) Systems Act.
