AMENDMENT TO HOUSE BILL 442

2     AMENDMENT NO. ______. Amend House Bill 442, AS AMENDED,
3 with reference to page and line numbers of Senate Amendment No.
4 1, on page 6, by inserting below line 13 the following:
5     "(k-1) At an intersection equipped with an automated
6 traffic law enforcement system, the yellow light change
7 interval must be not less than 3 seconds, unless an engineering
8 study indicates that a shorter interval is necessary for safety
9 purposes, nor more than 6 seconds.
10     (k-2) Except as otherwise provided in this subsection
11 (k-2), an intersection may not be equipped with an automated
12 traffic law enforcement system unless the following
13 requirements have been met:
14         (1) The county or municipality having jurisdiction has
15     determined that the intersection has a high accident rate.
16     Before such a determination is made, the county or
17     municipality must have performed or caused to be performed
18     an evaluation of accident rates for a 6-month period.

1         (2) All roads converging at the intersection are
2     controlled by traffic signals.
3     This subsection (k-2) does not apply to an intersection
4 that was equipped with an automated traffic law enforcement
5 system before the effective date of this amendatory Act of the
6 96th General Assembly.
7     (k-3) During the first 2 months that an intersection is
8 equipped with an automated traffic law enforcement system, an
9 additional sign meeting the requirements of subsection (k) and
10 this subsection must be posted at an intersection being
11 monitored by an automated traffic law enforcement system. The
12 sign in this subsection must be equipped with flashing yellow
13 lights and must indicate that violation notices will be issued
14 and the amount of the fine or penalty for violation.".
