SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Lease of Closed State Properties Act. Requires that the Department of Natural Resources and the Illinois Historic Preservation Agency offer to lease to any interested unit of local government, non-profit organization, or public or private college or university the operation and maintenance of any closed State park or historic site for one dollar. Provides that the leasing entity shall retain all revenues generated by such operation during the term of the lease. At the end of the lease, requires the State to reimburse the leasing entity for the undepreciated portion of any improvements made or paid for by the entity. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Lease
5 of Closed State Properties Act.
 
6     Section 5. Definitions. As used in this Act:
7     "Agency" means the Illinois Historic Preservation Agency.
8     "Department" means the Department of Natural Resources.
9     "Local entity" means a unit of local government, non-profit
10 organization, or public or private college or university
11 located in Illinois.
 
12     Section 10. Lease of closed State properties.
13     (a) Notwithstanding any other law, the Department and the
14 Agency shall each offer to any interested local entity the
15 opportunity to assume the operation and maintenance of any
16 closed State park or closed State historic site, under the
17 Department's or Agency's jurisdiction, through a lease in
18 consideration of one dollar paid by the local entity.
19     (b) The period of any lease under this Act shall be agreed
20 upon by the parties but may not be for a period less than one
21 year or longer than 5 years.
22     (c) All revenues generated by a local entity's operation of

1 a park or site during a lease under this Act shall be retained
2 by that local entity and must be used for the operation,
3 maintenance, or operation and maintenance of that park or site.
4     (d) Upon expiration or termination of a lease under this
5 Act, the local entity shall be reimbursed by the Department or
6 Agency, as the case may be, for the undepreciated portion of
7 any improvements to the park or site made or paid for by the
8 local entity during the period of the lease.
 
9     Section 99. Effective date. This Act takes effect upon
10 becoming law.
