AMENDMENT TO SENATE BILL 2124

2     AMENDMENT NO. ______. Amend Senate Bill 2124, on page 2, by
3 replacing lines 1 through 6 with the following:
 
4     "(c) No complaint shall be filed under this Article against
5 a person who occupies a single family residence, apartment,
6 condominium unit, or dwelling unit before January 1, 2010, if
7 the person is lawfully in possession and has paid the current
8 month's rent and the only default that the complaint would
9 allege is overdue rent. However, this subsection (c) does not
10 bar the filing of a complaint for overdue rent or for
11 possession based on grounds other than overdue rent. If a
12 complaint for possession alleges grounds other than or in
13 addition to overdue rent, the action proceeds to judgment, and
14 the judgment only finds overdue rent as a basis for possession,
15 the court shall provide the defendant with an opportunity to
16 pay the current month's rent and remain in possession; if the
17 defendant pays the current month's rent, the court shall stay

1 the order for possession provided that the defendant continues
2 to pay rent on a timely basis. Before January 1, 2010, a
3 defendant may only invoke or be granted the protections
4 provided by this subsection (c) one time.".
