SYNOPSIS AS INTRODUCED:
 
215 ILCS 170/37 new
305 ILCS 5/12-4.37 new

    Amends the Covering ALL KIDS Health Insurance Act and the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to establish a weight loss and management pilot program in partnership with a private entity that specializes in weight loss and weight control. Provides that to be eligible to participate in the program, an individual must: (1) be enrolled in the Covering ALL KIDS health insurance program or the Medicaid program; (2) be characterized as morbidly obese using a body mass index as recognized by the Centers for Disease Control and Prevention; (3) demonstrate a commitment to weight loss; and (4) demonstrate a commitment to participating in a program designed for weight loss and weight management. Effective July 1, 2007.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Covering ALL KIDS Health Insurance Act is
5 amended by adding Section 37 as follows:
 
6     (215 ILCS 170/37 new)
7     Sec. 37. Weight loss and management pilot program. Persons
8 eligible for benefits under this Act are eligible to
9 participate in the weight loss and management pilot program
10 established under Section 12-4.37 of the Illinois Public Aid
11 Code if they meet the other requirements set forth in that
12 Section.
 
13     Section 10. The Illinois Public Aid Code is amended by
14 adding Section 12-4.37 as follows:
 
15     (305 ILCS 5/12-4.37 new)
16     Sec. 12-4.37. Weight loss and management pilot program. The
17 Department of Healthcare and Family Services shall establish a
18 weight loss and management pilot program in partnership with a
19 private entity that specializes in weight loss and weight
20 control. To be eligible to participate in the pilot program, an
21 individual must:

1         (1) be enrolled in the Covering ALL KIDS health
2     insurance program under the Covering ALL KIDS Health
3     Insurance Act or the medical assistance program under
4     Article V of this code;
5         (2) be characterized as morbidly obese using a body
6     mass index as recognized by the Centers for Disease Control
7     and Prevention;
8         (3) demonstrate a commitment to weight loss; and
9         (4) demonstrate a commitment to participating in a
10     program designed for weight loss and weight management.
11     The Department may adopt any rules necessary for the
12 implementation of the pilot program.
 
13     Section 99. Effective date. This Act takes effect July 1,
14 2007.
