SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/4-220 new

    Amends the Illinois Highway Code. Provides that bicycle and pedestrian ways shall be given full consideration in the planning and development of transportation facilities, including the incorporation of such ways into State-funded transportation plans and programs. Provides that bicycle and pedestrian ways shall be established in conjunction with the construction, reconstruction, or other change of any State transportation facility, and special emphasis shall be given to projects in or within one mile of an urban area. Provides for exceptions. Requires the Department of Transportation to establish design and construction standards for bicycle and pedestrian ways. Effective July 1, 2007.

1     AN ACT concerning roads.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Highway Code is amended by adding
5 Section 4-220 as follows:
 
6     (605 ILCS 5/4-220 new)
7     Sec. 4-220. Bicycle and pedestrian ways.
8     (a) Bicycle and pedestrian ways shall be given full
9 consideration in the planning and development of
10 transportation facilities, including the incorporation of such
11 ways into State-funded transportation plans and programs.
12 Bicycle and pedestrian ways shall be established in conjunction
13 with the construction, reconstruction, or other change of any
14 State transportation facility, and special emphasis shall be
15 given to projects in or within one mile of an urban area.
16     (b) Notwithstanding the provisions of subsection (a),
17 bicycle and pedestrian ways are not required to be established:
18         (1) where their establishment would be contrary to
19     public safety;
20         (2) when the cost would be excessively
21     disproportionate to the need or probable use;
22         (3) where other available means or factors indicate an
23     absence of need; or

1         (4) in pavement resurfacing projects that do not widen
2     the existing traveled way and do not provide stabilized
3     shoulders, unless (i) local support is evident or (ii)
4     bicycling and walking accommodations can be added within
5     the overall scope of the original roadwork.
6     (c) Exceptions for the non-inclusion of bicycle and
7 pedestrian ways shall be approved by the Director and be
8 documented with supporting data that indicates the basis for
9 the decision.
10     (d) The Department shall establish design and construction
11 standards for bicycle and pedestrian ways.
12     (e) Beginning July 1, 2007, this Section shall apply to
13 planning and training purposes only. Beginning July 1, 2008,
14 this Section shall apply to construction projects.
 
15     Section 99. Effective date. This Act takes effect July 1,
16 2007.
