SYNOPSIS AS INTRODUCED:
 
New Act

    Creates a New Act. Creates the Official Flags Restricted Sales Act. Provides that no person shall sell or offer for sale at retail in Illinois after January 1, 2009, any of the following flags, unless the flag was manufactured in the United States: the United States flag, the State flag of Illinois, or a MIA or POW flag. Provides that a person who violates this prohibition is guilty of a Class C misdemeanor.

1     AN ACT concerning civil law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Official Flags Restricted Sales Act.
 
6     Section 5. Restricted official flag sales.
7     (a) A person shall not sell or offer for sale at retail in
8 this State on or after January 1, 2009, any of the following
9 flags, unless the flag was manufactured in the United States:
10         (1) The United States flag.
11         (2) The State flag of Illinois.
12         (3) A flag representing or commemorating United States
13     soldiers characterized as missing in action or prisoners of
14     war.
15     (b) For purposes of this Act, "person" includes an
16 individual, an owner or operator of a retail mercantile
17 establishment, or an agent, employee, officer, director,
18 franchisee, or independent contractor of the owner or operator.
 
19     Section 10. Penalty. A person violating this Section shall
20 be guilty of a Class C misdemeanor. Each sale made in violation
21 of this Act constitutes a separate offense.
