SYNOPSIS AS INTRODUCED:
 
410 ILCS 315/2a   from Ch. 111 1/2, par. 22.12a

    Amends the Communicable Disease Prevention Act. Deletes a Section requiring the Illinois Department of Public Health or a local public health department to give notice to a principal of the school in which a child is enrolled when a school aged child has acquired immune deficiency syndrome (AIDS) or AIDS-related complex (ARC) or has been shown to have been exposed to human immunodeficiency virus (HIV) or any other identified causative agent of AIDS. Effective immediately.

1     AN ACT concerning public health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Communicable Disease Prevention Act is
5 amended by changing Section 2a as follows:
 
6     (410 ILCS 315/2a)  (from Ch. 111 1/2, par. 22.12a)
7     Sec. 2a. (Blank). Whenever a child of school age is
8 reported to the Illinois Department of Public Health or a local
9 health department as having been diagnosed as having acquired
10 immune deficiency syndrome (AIDS) or AIDS-related complex
11 (ARC) or as having been shown to have been exposed to human
12 immunodeficiency virus (HIV) or any other identified causative
13 agent of AIDS by testing positive on a Western Blot Assay or
14 more reliable test, such department shall give prompt and
15 confidential notice of the identity of the child to the
16 principal of the school in which the child is enrolled. If the
17 child is enrolled in a public school, the principal shall
18 disclose the identity of the child to the superintendent of the
19 school district in which the child resides.
20     The principal may, as necessary, disclose the identity of
21 an infected child to:
22     (1) the school nurse at that school;
23     (2) the classroom teachers in whose classes the child is

1 enrolled; and
2     (3) those persons who, pursuant to federal or state law,
3 are required to decide the placement or educational program of
4 the child.
5     In addition, the principal may inform such other persons as
6 may be necessary that an infected child is enrolled at that
7 school, so long as the child's identity is not revealed.

9     Section 99. Effective date. This Act takes effect upon
10 becoming law.
