1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Capital Development Board Act is amended by
5 changing Section 10.09-5 as follows:
 
6     (20 ILCS 3105/10.09-5)
7     Sec. 10.09-5. Standards for an energy code. To adopt rules,
8 by January 1, 2004, implementing a statewide energy code for
9 the construction or repair of State facilities described in
10 Section 4.01. The energy code adopted by the Board shall
11 incorporate standards promulgated by the American Society of
12 Heating, Refrigerating and Air-conditioning Engineers, Inc.,
13 (ASHRAE). In proposing rules, the Board shall consult with the
14 Department of Commerce and Economic Opportunity Community
15 Affairs.

17     Section 10. The Energy Efficient Commercial Building Act is
18 amended by changing Section 10 as follows:

20     Sec. 10. Definitions.
21     "Board" means the Capital Development Board.
22     "Code" means the latest published edition of the
23 International Code Council's International Energy Conservation
24 Code, excluding published supplements but including 2000
25 International Energy Conservation Code, the ASHRAE 90.1-1999
26 Standard, which is included within that Code, the 2001
27 supplement to that Code, and the adaptations to the Code that
28 are made by the Board.
29     "Commercial building" means any building except a building
30 that is a residential building, as defined in this Section.

1     "Department" means the Department of Commerce and Economic
2 Opportunity.
3     "Municipality" means any city, village, or incorporated
4 town.
5     "Residential building" means (i) a detached one-family or
6 2-family dwelling or (ii) any building that is 3 stories or
7 less in height above grade that contains multiple dwelling
8 units, in which the occupants reside on a primarily permanent
9 basis, such as a townhouse, a row house, an apartment house, a
10 convent, a monastery, a rectory, a fraternity or sorority
11 house, a dormitory, and a rooming house.

13     Section 99. Effective date. This Act takes effect upon
14 becoming law.
