SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/24-11 new

    Amends the Criminal Code of 1961. Provides that the provisions of any ordinance or resolution adopted by any unit of local government that impose restrictions or limitations on the acquisition, possession, transportation, storage, purchase, sale, or other dealing in firearms and firearm ammunition, components, accessories, and accoutrements for firearms that do not provide an exception for the use or possession of a firearm for the act of self-defense or defense of another when on one's land or in one's abode or fixed place of business are invalid, and all those existing ordinances and resolutions are void. Provides that a unit of local government, including a home rule unit, may not regulate the possession or use of a firearm kept for self-defense or defense of another and may not regulate ammunition, components, accessories, or accoutrements for such firearm. Effective immediately.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 24-11 as follows:
 
6     (720 ILCS 5/24-11 new)
7     Sec. 24-11. Self-defense.
8     (a) The provisions of any ordinance or resolution adopted
9 before, on, or after the effective date of this amendatory Act
10 of the 94th General Assembly by any unit of local government
11 that impose restrictions or limitations on the acquisition,
12 possession, transportation, storage, purchase, sale, or other
13 dealing in firearms and firearm ammunition, components,
14 accessories, and accoutrements for firearms that do not provide
15 an exception for the use or possession of a firearm for the act
16 of self-defense or defense of another as defined in Sections
17 7-1 and 7-2 of this Code when on one's land or in one's abode or
18 fixed place of business are invalid, and all those existing
19 ordinances and resolutions are void.
20     (b) A unit of local government, including a home rule unit,
21 may not regulate the possession or use of a firearm kept for
22 self-defense or defense of another and may not regulate
23 ammunition, components, accessories, or accoutrements for such
24 firearm. This Section is a limitation under subsection (h) of
25 Section 6 of Article VII of the Illinois Constitution on the
26 exclusive exercise by home rule units of powers and functions
27 exercised by the State.
 
28     Section 99. Effective date. This Act takes effect upon
29 becoming law.
