AMENDMENT TO HOUSE BILL 323

2     AMENDMENT NO. ______. Amend House Bill 323 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The State Vehicle Identification Act is amended
5 by changing Section 4 and by adding Section 4.5 as follows:
 
6     (30 ILCS 610/4)  (from Ch. 127, par. 133e4)
7     Sec. 4. Sections 2 and 3 This Act shall not apply to
8 vehicles used by elective State officers, by executive heads of
9 State agencies and departments, by presidents of colleges or
10 universities placed under control of officers of this State, or
11 by any employee of a State agency or department in the
12 performance of investigative services exclusively when the
13 executive head thereof has requested an exception in writing,
14 and such exception has been approved in writing by the
15 Department, on the basis that the identification would hamper
16 the individual employee in the routine performance of his
17 investigative duties. A record, open to public inspection,
18 shall be kept by the Department of all such exceptions approved
19 by it.
20     Sections 2 and 3 This Act shall not apply to vehicles
21 assigned to the use of the Department of State Police and the
22 Division of Law Enforcement of the Department of Natural
23 Resources, and the executive heads thereof shall have within
24 their discretion determination of the type of markings or

1 identification, if any, to be affixed to vehicles assigned to
2 said Department or Division nor shall Sections 2 and 3 this Act
3 apply to vehicles assigned to the use of Secretary of State
4 police officers.

7     Sec. 4.5. Decals.
8     (a) In order that vehicles are identifiable as State
9 property, each vehicle owned by the State shall bear on its
10 driver's door and the lid of its trunk decals with a small
11 State seal and the name of the State agency using the vehicle.
12     (b) A State agency may request from the Joint Committee on
13 Administrative Rules, and the Joint Committee may approve,
14 exemptions to the requirement of subsection (a) for reasonable
15 security purposes. The Joint Committee on Administrative Rules
16 shall maintain as a public record a list of exempt vehicles
17 identified by license plate numbers.
18     (c) This Section does not apply to vehicles assigned to
19 members of the General Assembly and employees of the
20 legislative branch of State government.".
