AMENDMENT TO SENATE BILL 3211

2     AMENDMENT NO. ______. Amend Senate Bill 3211 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the Right
5 to Breastfeed Act.
 
6     Section 5. Breastfeeding Location. A mother may breastfeed
7 her baby in any location, public or private, where the mother
8 is otherwise authorized to be, irrespective of whether the
9 nipple of the mother's breast is uncovered during or incidental
10 to the breastfeeding.
 
11     Section 90. The Illinois Insurance Code is amended by
12 changing Section 356s as follows:
 
13     (215 ILCS 5/356s)
14     Sec. 356s. Post-parturition care.
15     (a) An individual or group policy of accident and health
16 insurance that provides maternity coverage and is amended,
17 delivered, issued, or renewed after the effective date of this
18 amendatory Act of 1996 shall provide coverage for the
19 following:
20         (1) a minimum of 48 hours of inpatient care following a
21 vaginal delivery for the mother and the newborn, except as
22 otherwise provided in this Section; or

1         (2) a minimum of 96 hours of inpatient care following a
2 delivery by caesarian section for the mother and newborn,
3 except as otherwise provided in this Section.
4     A shorter length of hospital inpatient stay for services
5 related to maternity and newborn care may be provided if the
6 attending physician licensed to practice medicine in all of its
7 branches determines, in accordance with the protocols and
8 guidelines developed by the American College of Obstetricians
9 and Gynecologists or the American Academy of Pediatrics, that
10 the mother and the newborn meet the appropriate guidelines for
11 that length of stay based upon evaluation of the mother and
12 newborn and the coverage and availability of a post-discharge
13 physician office visit or in-home nurse visit to verify the
14 condition of the infant in the first 48 hours after discharge.
15     (b) An individual or group policy of accident and health
16 insurance that provides maternity coverage and is amended,
17 delivered, issued, or renewed after the effective date of this
18 amendatory Act of the 93rd General Assembly shall provide
19 coverage for lactation consultant service requested by the
20 enrollee for 3 months within the first 6 months after the date
21 of delivery of the enrollee's child. Benefits provided under
22 this subsection (b) may be made subject to a deductible,
23 co-payment, or co-insurance requirement.
