SYNOPSIS AS INTRODUCED:
 
705 ILCS 35/4.4 new

    Amends the Circuit Courts Act. Provides that, in civil cases requiring a court interpreter, the court may order the non-prevailing party to pay the reasonable fees and expenses of the court interpreter. Provides that, in a criminal case requiring a court interpreter in which the defendant is found guilty of the charges brought against him or her, the circuit court may order the defendant to pay the reasonable fees and expenses of the court interpreter. Allows the circuit court the ability to adjust unreasonable fees and expenses of a court interpreter.

1     AN ACT concerning circuit courts.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Circuit Courts Act is amended by adding
5 Section 4.4 as follows:
 
6     (705 ILCS 35/4.4 new)
7     Sec. 4.4. Court interpreter fees.
8     (a) In civil cases requiring a court interpreter, the court
9 may order the non-prevailing party to pay the reasonable fees
10 and expenses of the court interpreter.
11     (b) In a criminal case requiring a court interpreter in
12 which the defendant is found guilty of the charges brought
13 against him or her, the circuit court may order the defendant
14 to pay the reasonable fees and expenses of the court
15 interpreter. In criminal cases requiring a court interpreter in
16 which the defendant is found not guilty of the charges brought
17 against him or her, the circuit court shall pay the reasonable
18 fees and costs of the court interpreter.
19     (c) The circuit court shall have the ability to adjust
20 unreasonable fees and expenses of a court interpreter.
