    Amends the Department of Revenue Law of the Civil Administrative Code of Illinois and the Riverboat Gambling Act. Provides that only the Department of State Police has the authority to conduct investigations, searches, seizures, and arrests aboard riverboats. Effective July 1, 2004.

1     AN ACT concerning gaming.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Revenue Law of the Civil
5 Administrative Code of Illinois is amended by changing Section
6 2505-305 as follows:
 
7     (20 ILCS 2505/2505-305)  (was 20 ILCS 2505/39b15.1)
8     Sec. 2505-305. Investigators.
9     (a) Except as otherwise provided in Section 22.1 of the
10 Riverboat Gambling Act, the Department has the power to appoint
11 investigators to conduct all investigations, searches,
12 seizures, arrests, and other duties imposed under the
13 provisions of any law administered by the Department or the
14 Illinois Gaming Board. Except as provided in subsection (c),
15 these investigators have and may exercise all the powers of
16 peace officers solely for the purpose of enforcing taxing
17 measures administered by the Department or the Illinois Gaming
18 Board.
19     (b) The Director must authorize to each investigator
20 employed under this Section and to any other employee of the
21 Department exercising the powers of a peace officer a distinct
22 badge that, on its face, (i) clearly states that the badge is
23 authorized by the Department and (ii) contains a unique
24 identifying number. No other badge shall be authorized by the
25 Department.
26     (c) Investigators appointed under this Section who are
27 assigned to the Illinois Gaming Board have and may exercise all
28 the rights and powers of peace officers, provided that these
29 powers shall be limited to offenses or violations occurring or
30 committed on a riverboat or dock, as defined in subsection
31 subsections (d) and (f) of Section 4 of the Riverboat Gambling
32 Act.

3     Section 10. The Riverboat Gambling Act is amended by adding
4 Section 22.1 as follows:
 
5     (230 ILCS 10/22.1 new)
6     Sec. 22.1. State Police. Beginning on the effective date of
7 this amendatory Act of the 93rd General Assembly,
8 notwithstanding any other law to the contrary, only the
9 Department of State Police has the authority to conduct
10 investigations, searches, seizures, and arrests aboard
11 riverboats.
 
12     Section 99. Effective date. This Act takes effect on July
13 1, 2004.
