1     AN ACT concerning public utilities.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by changing
5 Section 16-101 as follows:
 
6     (220 ILCS 5/16-101)
7     Sec. 16-101. Short title and applicability.
8     (a) This Article shall be known and may be cited as the
9 Electric Service Customer Choice and Rate Relief Law of 1997
10 and shall apply to electric utilities and alternative retail
11 electric suppliers as defined in this Article. Except to the
12 extent modified or supplemented by the provisions of this
13 Article, or where the context clearly renders such provisions
14 inapplicable, the other Articles of the Public Utilities Act
15 pertaining to public utilities, public utility rates and
16 services and the regulation thereof, are fully and equally
17 applicable to the tariffed services electric utilities
18 provide.
19     (b) The provisions of subsections (a) through (h) of
20 Section 16-111 of this Act shall not be applicable to any
21 electric utility which elects to file biennial rate proceedings
22 before the Commission in the years 1998, 2000 and 2002. An
23 electric utility electing this option shall do so by filing a
24 notice of such election with the Commission within 60 days
25 after the effective date of this amendatory Act of 1997, or its
26 right to make such election shall be irrevocably waived. An
27 electric utility electing the option specified in this
28 paragraph shall file its rate proceeding with the Commission no
29 later than August 1 of the years 1998, 2000, and 2002. The
30 electric utility's filing shall comply with all requirements of
31 83 Illinois Administrative Code Parts 255 and 285 as though the
32 electric utility were filing for an increase in its rates,

1 without regard to whether such filing would produce an
2 increase, a decrease or no change in the electric utility's
3 rates and the Commission shall review the electric utility's
4 filing and shall issue its order in accordance with the
5 provisions of Section 9-201 of this Act.
