AMENDMENT TO HOUSE BILL 4735

2     AMENDMENT NO. ______. Amend House Bill 4735, AS AMENDED,
3 with reference to page and line numbers of House Amendment No.
4 1, on page 1, by replacing line 8 with the following:
5     "(a) For the purposes of this Section:
6     "Nursing facility""; and
 
7 on page 1, line 14, after "Code", by inserting "and that is
8 certified under Title XIX of the Social Security Act"; and
 
9 on page 1, immediately below line 17, by inserting the
10 following:
11     ""Conversion and modernization" means the construction,
12 alteration, reconstruction, renovation, modernization, or
13 improvement of existing nursing facility beds or areas within
14 an existing nursing facility."; and
 
15 on page 1, line 24, by replacing "construction, alteration,"
16 with "conversion and modernization of"; and
 
17 on page 2, by deleting line 1; and
 
18 on page 2, line 5, by replacing "as defined in" with "or a
19 special program or unit for persons with Alzheimer's disease or
20 related disorders licensed under"; and

1 on page 2, by replacing lines 18 and 19 with the following:
2     "(d) A conversion and modernization shall not have the
3 effect of:"; and
 
4 on page 3, by replacing line 1 with the following:
5 "conversion and modernization that"; and
 
6 on page 3, line 6, by replacing "Conversions or" with
7 "Conversion and"; and
 
8 on page 3, line 15, after "20%", by inserting ", and may offer
9 to provide more than 20%,"; and
 
10 on page 3, by replacing lines 24 through 28 with the following:
11         "(1) the unique needs of residents and their caregivers
12 in the area in which the facility is located;
13         (2) the nursing facility bed need in the area in which
14 the facility is located;
15         (3) the extent to which the conversion and
16 modernization results in the reduction of certified
17 nursing facility beds in an area with excess beds;
18         (4) compliance history with licensure and
19 certification requirements; and
20         (5) the extent to which the application reflects
21 collaboration and support for the conversion or
22 modernization by other providers and local government
23 leaders in the community."; and
 
24 on page 3, by replacing lines 32 and 33 with the following:
25 "Public Health, in coordination with the Director of Public
26 Aid, the Director of Aging, and the Secretary of Human
27 Services."; and
 
28 on page 4, line 2, by replacing "licensed" with "certified";

2 on page 4, line 22, by replacing "relocate" with "move or
3 transfer"; and
 
4 on page 4, immediately below line 24, by inserting the
5 following:
6     "(l) Nothing in this Section shall prohibit a nursing
7 facility from moving or transferring a resident as authorized
8 by the Nursing Home Care Act."; and
 
9 on page 4, lines 26 and 27, by replacing "Aid and the Director
10 of Aging" with "Aid, the Director of Aging, and the Secretary
11 of Human Services"; and
 
12 on page 4, immediately below line 33, by inserting the
13 following:
 
14     "Section 90. The Illinois Health Facilities Planning Act is
15 amended by adding Section 12.05 as follows:
 
16     (20 ILCS 3960/12.05 new)
17     Sec. 12.05. Nursing Facility Conversion and Modernization
18 Act. The criteria and standards for health care planning,
19 including but not limited to the statewide inventory
20 established under Section 12 of this Act, shall not be adjusted
21 by any change in the number of nursing facility beds resulting
22 from nursing home conversion or modernization pursuant to the
23 Nursing Facility Conversion and Modernization Act.".
