 1        AN ACT in relation to public utilities.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4    Section 5.  The Public Utilities Act  is  amended  by  adding
 5    Sections 13-225 and 13-804 as follows:

 6        (220 ILCS 5/13-225 new)
 7        (Section scheduled to be repealed on July 1, 2005)
 8        Sec.  13-225. Residential service price-cap company means
 9    a telecommunications carrier  that  provided  local  exchange
10    telecommunications service to 100,000 or more residential end
11    users  on  January  1, 2003 using a network elements platform
12    that was required to be provided to the carrier  pursuant  to
13    Section 13-801(d)(4).

15        (Section scheduled to be repealed on July 1, 2005)
16        Sec.13-804.   Residential   service   Price-cap  Company;
17    requirements.
18        (a)  Any residential service price-cap company  shall  be
19    subject to the price cap provisions of this Section.
20        (b)  Each   telecommunications  carrier  subject  to this
21    Section shall, within 30 days after the   effective  date  of
22    this  amendatory  Act of 2003, certify to the Commission that
23    its  rates for basic residential service are no greater  than
24    the   rates  in  effect  on January 1, 2003.  As used in this
25    Section, the term "basic residential service"  has  the  same
26    meaning as in subsection (c) of Section 13-506.1
27        (c)  If  a residential service price-cap company does not
28    increase  its  rates  during  the  period  beginning  on  the
29    effective date of this amendatory Act  of  the  93rd  General
30    Assembly  and  ending on July 1, 2005 to a level greater than

 1    the rates that were in  effect  on  January  1,  2003,  then,
 2    during  that period, neither the Commission nor any incumbent
 3    local exchange carrier shall (1) approve an increase  in  the
 4    rate for a network elements platform charged to a residential
 5    service price-cap company; or (2) reduce the network elements
 6    available  to  residential  service  price-cap  companies for
 7    purchase below that which was available  on January 1,  2003.
 8    For  the purposes of this Section, the rates certified to the
 9    Commission shall not include promotions.
