 1                    AMENDMENT TO HOUSE BILL 2509

 2        AMENDMENT NO.     .  Amend House Bill 2509  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The  Public  Utilities  Act  is  amended by
 5    adding Section 13-1001 as follows:

 6        (220 ILCS 5/13-1001 new)
 7        (Section scheduled to be repealed on July 1, 2005)
 8        Sec. 13-1001.  Phone number utilization.
 9        (a)  It is the intent of the General  Assembly  that  the
10    Commission   undertake   any  and  all  efforts  to  conserve
11    telephone numbers, prevent the imposition of new  area  codes
12    in  Illinois  until  proven  necessary,  and provide Illinois
13    citizens  with   information   regarding   telephone   number
14    utilization in this State.
15        (b)  The   Commission   shall   obtain   and  review  the
16    semi-annual Number Resource Utilization and Forecast  Reports
17    from   the   North  American  Numbering  Plan  Administration
18    (NANPA).
19        (c)  The Commission  shall  identify  to  NANPA  and  the
20    Federal   Communications  Commission  any  telecommunications
21    carrier  that  is  not  in  compliance   with   the   Federal
22    Communications Commission's "request threshold", "utilization

 1    requirement",  "sequential  numbering  requirement",  or  any
 2    other  Federal  Communications  Commission number utilization
 3    rules identified in its  2  Numbering  Resource  Optimization
 4    Orders,  In  the  Matter  of Number Resource Optimization, CC
 5    99-200, FCC 00-104, Report and Order (rel.  March  31,  2000)
 6    codified in part at 47 CFR 52.15, and In the Matter of Number
 7    Resource  Optimization,  CC 99-200, FCC 00-429, Second Report
 8    and Order (rel. December 29, 2000) codified in part at 47 CFR
 9    52.15.  The  Commission  shall  request  that   the   Federal
10    Communications   Commission   audit   any  telecommunications
11    carrier not in  compliance with  the  Federal  Communications
12    Commission's numbering resource optimization rules, provided,
13    however, that the carrier must first be notified and given an
14    opportunity  to respond to the alleged noncompliance.  Within
15    30 days  after  receiving  the  results  of  the  audit,  the
16    Commission   shall  issue  a  report  outlining  the  audit's
17    findings and document any actions planned or taken to  ensure
18    compliance with the Federal Communications Commissions number
19    resource optimization rules.
20        (d)  Within 30 days after the Commission's receipt of the
21    NANPA  biannual  Number  Resource  Utilization  and  Forecast
22    Reports,   the   Commission   shall  issue  a  public  report
23    containing the aggregated utilization rate by area  code  for
24    every  telecommunications  carrier  that has phone numbers in
25    any Illinois area code.  The Commission's report may  contain
26    any  explanatory or other relevant information the Commission
27    deems necessary.".
